Dear Commissioners:
I am writing to express my support for the appeal of Application 25033 and to request
a reversal of the decision.
I agree with the appeal in the following points:ied this project last summer. The public
••Public hearing rights: The commission denied this project last summer. The public
have a right to a new public hearing on the matter, not simply be subjected to an
internal approval.
•Failure to Apply NCOD Standards: City staff erred by not applying
mandatory Neighborhood Conservation Overlay District (NCOD) standards to the
building's form, mass, and scale, violating code 38.230.100A.5.c. The proposed
development is
incompatible with the surrounding neighborhood. So many people with intentions of
improving their homes, lots, etc have been denied on the NCOD reststriction basis.
Why is this project different? These standards are there for a reason and all should be
treated equally, including developers.
•Violation of Design Criteria: The application does not meet the design
integration standards with the existing neighborhood as required by code
38.230.100.A.7.
•Flawed Traffic Study: City staff ignored critical deficiencies in the traffic
study concerning surrounding intersections.
•Illegal Demolition Approval: City staff violated code 38.340.120.D.3, which mandates
a two-year demolition stay after a project denial, to explore alternatives.
I urge the Bozeman City Commission to reverse the decision on Application
25033.
Please listen to the citizens of the town, the people who actually live and work here
and have made this city what it is with our labor, communities, dialog and a
collaborative spirit.
