WATER PIPELINE AND ACCESS EASEMENT AND AGREEMENT
Montana StateUniversity-Bozeman,theGRANTOR,inconsiderationof $1.00and othergood
and valuableconsideration,receiptof which isacknowledged,grant(s)to The Cityof Bozeman,
a municipalcorporationoftheStateofMontana,with officeat 121 North Rouse Avenue,
Bozeman Montana 59715,GRANTEE,itssuccessorsand assigns,a perpetualeasementtolay,
constructand maintainwaterpipelineswith theusualservices,valves,connections,accessories
and appurtenancesforthepurposeoftransmittingwaterin,through,and acrossa stripofland
situatedinGallatinCounty,Montana,thirty(30)feetwide tobe locatedon thefollowing
describedrealproperty:
Lot 1 of Block 8 of CapitalHillAdditiontotheCityofBozeman and theabandoned
portionof 10thAvenue South (PlatC-37),locatedintheNortheastOne-Quarterof
Section13,Township 2 South,Range 5 East,PrincipalMeridian Montana,Cityof
Bozeman,GallatinCounty,Montana.
The easement ismore particularlydescribedon theattachedExhibit"A"which by this
referencearemade a parthereof.
ThisgrantincludestherightoftheGRANTEE (BZN),itssuccessors,and or assigns,to
enteratalltimesupon theabove-describedlandby usingexistingroadsortrailsorotherwiseby
a routecausingtheleastdamage and inconveniencetotheGRANTOR (MSU)inorderto:-
operate,repair,replaceand maintainthepipeline,services,connections,accessoriesand
appurtenances;trim,remove,destroy,orotherwisecontrolany treesand brush insideor outside
theboundariesoftheeasement which may,intheopinionof theGRANTEE (BZN),interfereor
threatentointerferewithorbe hazardoustotheoperation,maintenance,orreplacementofthe
pipeline;
GRANTEE (BZN)agreesthat,inconnectionwith the-operating,repairing,replacing,and

maintainingofsaidwaterpipeline,itwillrepairor replace,atitssoleexpense,orpay to
GRANTOR (MSU)thereasonablevalueofany damages togrowing crops,existingfences,
ditchesand otherappurtenancesofsaidlandthatmay be disturbedby itsoperation.
GRANTOR (MSU)may relocatetheEasement ifintheopinionofGRANTOR (MSU)it
unreasonablyinterfereswith thepresentor futureuse by GRANTOR (MSU)ofGRANTOR'S
(MSU)land.GRANTOR (MSU)shallprovidetoGRANTEE (BZN)a substituteeasement area
asreasonablysuitedtoGRANTEE'S (BZN)needs inorderto sufficientlymaintain,operate,or
replacethewaterpipeline.Relocationshallbe atGRANTOR'S (MSU)solecostand expense.
GRANTOR (MSU)willthendraftforGRANTEE (BZN)reviewand signature,thenecessary
easement modificationagreements(s)tofacilitatesuch relocation.
GRANTOR (MSU)may terminatethisEasement and alloftherightsgrantedhereinif
thewatermain and appurtenancesaretakenoutofservice,abandoned,relocated,or removed.
GRANTOR (MSU)shallnotifyGRANTEE (BZN)2-yearspriortoterminationof theeasement
ifthepipelineistobe relocatedand 1-yearpriortoterminationifthepipelineistobe
decommissioned orremoved.Any and allinterestinGRANTOR'S (MSU)landconveyed inthis
Easement shallautomaticallyreverttoGRANTOR (MSU)oritsassignsand successors.
GRANTOR (MSU)may remove or abandon in-placeany and allimprovements itor GRANTEE
(BZN)installedin,on,under or above theeasement areaatGRANTOR'S (MSU)solecostand
expense.GRANTOR (MSU)willthendraftforGRANTEE (BZN)reviewand signature,the
necessaryeasement modificationagreement(s)orreleaseoftheEasement.
GRANTOR (MSU)warrantsthattheyarelawfullyseizedand possessedofthereal
propertydescribedabove,thattheyhave a lawfulrightto convey theproperty,orany partof it,
and thattheywillforeverdefendthetitletothispropertyagainsttheclaimsof allpersons.At no
timewillGRANTOR build,construct,erect,or maintainany permanent structurewithinthe
boundariesof saideasementwithoutthepriorwrittenconsentofGRANTEE.
GRANTEE (BZN)may peaceablyholdand enjoytherightsand privilegeshereingranted

withoutany interruptionby theGRANTOR (MSU).The terms,covenantsand provisionsofthis
easement and agreementshallextendtoand be bindingupon theheirs,executors,administrators,
personalrepresentatives,successorsand assignsofthepartieshereto.
