RE: DRAFT Concurrent Construction Plan – Oxbow Apartments Phase II
Dear Susanna,
Please consider this request for Concurrent Construction for the development of site and building
improvements, including water and sewer main extensions, for the Oxbow Apartments Phase II located in
Phase 2 of the Cottonwood Subdivision. The applicant plans to begin construction of the necessary
infrastructure as soon as practical following city engineering review and approval. The applicant is requesting
that the city issue the necessary building permits prior to the completion of the required infrastructure
improvements in accordance with BMC 38.270.030.C.
The Concurrent Construction Plan addressing the Exception for Concurrent Construction criteria is outlined
below:
1. Any required on-site or directly adjacent extensions of water mains, sewer mains, stormwater system, or
streets to be dedicated to the public:
• Must be located entirely within publicly held easements or rights-of-way

will be dedicated to the public and will be located entirely within a publicly head easement or ROW.
• Must serve only a single lot

• Are the subject of an irrevocable offer of dedication to the city upon completion of the project

send a current DRAFT of the city’s preferred irrevocable offer of dedication.
• The development is under the control of a single developer who must retain control of the entire project
until final completion.
Development and construction of Oxbow Phase II will be under control of a single ownership group. This
group will retain control of the entire project until final completion.

• All work is under the supervision of a single general contractor

• No subdivision of land is involved
No additional subdivision of land is required for the development of Oxbow Phase II. The site has already
received final plat approval under Phase 2 of the Cottonwood Subdivision.
2. The DRC must determine when the standards listed in BMC 38.270.030.C.1 are met
A request was made to the City of Bozeman Fire Department to consider whether adequate fire protection
services will be available. A copy of that request is included in this application.
3. Approval of the final engineering design, including location and grade, for the infrastructure project must
be obtained from the engineering department, and the Montana Department of Environmental Quality when
applicable, prior to issuance of any building permit for the development
All proposed extensions to public infrastructure will be reviewed and approved by the engineering
department and MDEQ. These reviews will be initiated through separate application.
4. A certificate of occupancy must not be issued until all on-site and off-site water, sewer, stormwater, and
street improvements necessary to serve the site are installed and accepted or approved as applicable by the
city.
The applicant acknowledges the requirement to obtain certificate of occupancy. This criteria is understood.

Concurrent Construction for the Oxbow Phase II development. We are confident that the development
