Hi Patrick. Brian Krueger asked if you could be given a receipt showing that you paid the cash-in-lieu of water rights for Co onwood Subdivision. I’m not sure
if anyone has done that yet. Below is a copy of the transac on in our system. It provides a receipt number so this should be sufficient for when you submit
your final plat applica on.

Per your request, attached you will find the preliminary CIL water rights determination for the Cottonwood Subdivision. Couple things to bear in mind
here:
1) Sec. 38.410.130 Bozeman Municipal Code allows a deferral of payment of CILWR beyond 1 multi-family unit on each multi-family tract being
platted. I’ve confirmed with Chris Budeski that all lots are purposed for future multi-family use. A note must be added to the final plat stating that
payment of additional CILWR is required for the lots prior to final plan approval of the future multi-family site plan development.
2) This prelim CILWR determination does not account for irrigation of parks and open spaces. If park/OS irrigation will be supplied by the City’s
municipal system then payment of CILWR for the anticipated irrigation water requirement for the landscape plans for park/OS will be required.
Alternatively, you may use exempt groundwater wells (preferred and encouraged) to supply irrigation for parks/OS. To use exempt well, you must
obtain a determination from MT DNRC that exempt wells are allowable for this purpose. Chris Budeski is familiar with this coordinating process with
DNRC. Exempt well water rights used for dedicated parkland irrigation must be held in ownership by City of Bozeman.
