HomeMy WebLinkAboutResolution 3405 Annex School DIstrict 27 acres on North 27th '" 111111111111 II II 1111112022564 ~ Page: 1 of 3 ~ 10/10/2000 04:04P Shelley Vanoe-Gallatin Co ~T ~ISC 18.00 / .._.u_____...__ COMMISSION RESOLUTION NO. 3405 ., ---,.- -ft A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA, EXTENDING THE BOUNDARIES OF SAID CITY OF BOZEMAN SO AS TO INCLUDE WITHIN THE CORPORATE LIMITS OF THE CITY OF BOZEMAN A TRACT OF LAND TO SAID CITY, TO BE KNOWN AS THE BOZEMAN SCHOOL DISTRICT ANNEXA TION AND HEREIN MORE PARTICULARL Y DESCRIBED. WHEREAS, the City of Bozeman received a petition for annexation from Bozeman School District No.7, containing the signatures of 100 percent of the real property owners of the area, requesting the City Commission to establish the boundaries of the City of Bozeman so as to include a certain tract of land located along the south side of East Valley Center Road, northwest of Costco and east of Davis Lane, in the County of Gallatin, State of Montana; and WHEREAS, an annexation staff report has been prepared in accordance with the Commission's goals and policies for annexation and was presented to the Commission; and WHEREAS, the City did not receive any written protest from the real property owners of the area to be annexed; and WHEREAS, on August 7, 2000, the Commission authorized and directed staff to process a Part 46 annexation and prepare the necessary documents to proceed with the annexation of this tract in accordance with their decision regarding the provision of services to said tract; and WHEREAS, the provision of available services including, but not limited to, rights-of- way, easements, water rights or cash in lieu, waivers of protest against creation of SID's and water and sewer hookup fees, to said tract of land is the subject of a written agreement between the City and Bozeman School District No.7, the record owners of the tract; and WHEREAS, said tract is the subject of a plat(s) or certificate(s) of survey, filed in the office of the Gallatin County Clerk and Recorder's Office; and WHEREAS, the Bozeman City Commission hereby finds that the annexation of this tract is in the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of the tract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 46, M.C.A., the following-described property be annexed to the City of Bozeman and that the boundaries of said . , ,- City shall be modified so as to embrace and include such 27.730 acres of land. to wit, and as further described on Exhibit A, attached hereto: A parcel of land being described as Lot 4A of Minor Subdivision No. 122A situated in the southwest one-quarter of Section 26, T1 S. R5E, P.M.M.. Gallatin County. Montana, being 27.730 acres along with and subject to any and all existing easements, and being further described as follows: Beginning at a point which bears N62 0 51' 17"W a distance of 66.37 feet from the S ~ of said Section 26, said point also being on the north Right-of-way line of a 30 foot wide dedicated public road; Thence from said True Point of Beginning along said line S89044'21 "W a distance of 1171.07 feet to a point being the southeast corner of Lot 3 of said Minor Subdivision No. 221; Thence along the east line of said Lot 3 NOo047'56"E a distance of 1031.68 feet to a point being the southwest corner of Lot 1 of said Minor Subdivision No. 221 ; Thence along the south line of said Lot 1 N88 044' 46" E a distance of 1171.07 feet to a point on the west Right-of-way line of Roxi Lane; Thence along said line SOo047'56"W a distance of 1 031.56 feet to the point of Beginning. Section 2 The effective date of this annexation is October 10, 2000. Section 3 The annexation of the above-described tract is subject to the terms of the Agreement dated October 2, 2000, by and between the City of Bozeman and Bozeman School District No.7. PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 2nd day of October 2000.
