Dec 12, 2024: 11:40am Mayor Terry Cunningham, Deputy Mayor Joey Morrison, and Commissioners Jennifer Madgic, Douglas Fischer, and Emma Bode: I am writing to ask the Bozeman City Commission (Commission) to reclaim review of The Guthrie V.2 (App. 24493).1 My request for the Commission to reclaim is based on (1) a quick review of the Public Notice for App. 24493 and on (2) the argument that administrative-only reviews violate theMT Constitution's guarantee of the public's right of participation (as follows): 1. The proposed The Guthrie V.2 is incompatible in mass and scale with the characterand sense of place of the surrounding neighborhood, does not provide adequate on- site parking near Whittier Elementary School, and pricing of the 46 so-called"affordable housing" units at 80% AMI will not, in reality, be affordable to the majority of Bozeman's workforce. 2. The MT Constitution, Article II Declaration of Rights, Section 8. RIGHT OF PARTICIPATION reads, "The public has the right to expect governmental agencies to afford such reasonable opportunity for citizen participation in the operation of the agencies prior to the final decision as may be provided by law." a. Arguably, administrative-only reviews violate this section of the MT Constitution —ethically if not legally—because administrative-only reviews are not public, not transparent, and erode trust between the public and the City of Bozeman. To conclude, I ask the Commission to reclaim review of The Guthrie V.2 (Application 24493). The proposed building will total 54,300 square feet, with a 12,747-square-foot footprint, and a maximum height of 47 feet. It will include 91 residential units, with an average unit size of 456 square feet, consisting of 20 studio apartments, 58 one-bedroom apartments, and 13 two-bedroom apartments. Out of the 91 units, 46 units (10 studio, 29 one-bedroom, and 7 two-bedroom) will be designated as affordable housing, priced at or below 80% of the area median income (AMI).
