RE: Resolution 5631: Reestablishment and Extension of the Meadow Creek Subdivision Payback

We would like to thank City Engineer Lance Lehigh for his very helpful explanation of what
Resolution 5631 entails and for giving us the tools to explore the information on the City’s website.
We would like to go on record opposing this extension request by MC Capital LLC for the Meadow
Creek Subdivision Payback. Because we live on Gallatin County land surrounded by the City, we do
not vote for City Commissioners who will make this decision affecting the future of our property.
“Taxation without representation” comes to mind. If we ever need to annex to the City of Bozeman,
we should not have to help MC Capital LLC pay for and make a profit for their Meadow Creek
Subdivision Development. We might add that this development is close to 2 miles away from where
we live.
Affordable housing has been a priority for many City, County and State Officials for many years and
we now live in Affordable Housing! That would not be the case if we ever need to hook up to City
sewer lines which would require annexation and be very expensive! Consequently, we maintain and
protect our private septic tank and leach field very closely. If we needed to annex, the Impact Fees,
construction costs, RID, SID, engineering costs, etc. would be overwhelming enough, without
helping to pay for a project so far away from where we live.
It's very unfortunate that the folks that could be affected by this Payback only have a short time to
respond, especially with the Holidays. We wonder if MC Capital LLC hiring Gallik and Bremer to
represent them in this Resolution could be a ‘Conflict of Interest’ because Gallik and Bremer’s Firm
helped Smith Subdivision Residents a few years ago in Zoning, Annexation and Development issues
that dealt with Payback concerns?
This is the first Resolution like this for a Payback request by City Commissioners and if approved, it
will set a very bad precedent for other developers who overextended their funds and want others to
pay for their profiting!
Thank you for considering our comments and please do not let this Payback Extension to be
approved!
