HomeMy WebLinkAbout24493 Notice NOTICE OF A SITE PLAN/COMMERCIAL CERTIFICATE OF APPROPRIATENESS WITH DEMOLITION APPLICATION This application is evaluated against the site plan criteria of section 38.230.100 and the certificate of appropriateness criteria of section 38.230.080 of the Bozeman municipal code (BMC) and associated standards. Per 38.230.100.B, BMC, approval is granted if all criteria are met. The public may comment in writing regarding compliance of this application with the required criteria. Comments should identify the specific criteria of concern along with facts in support of the comment. Per 38.250.030.B, BMC, issues not raised during public comment period may not be raised on appeal. Select Project Name: 5th and Villard (The Guthrie) Application: 24493 Summary: An application has been submitted for the demolition of an existing structure to construct a new four- story apartment building. The proposed building will total 54,300 square feet, with a 12,747-square-foot footprint, and a maximum height of 47 feet. It will include 91 residential units, with an average unit size of 456 square feet, consisting of 20 studio apartments, 58 one-bedroom apartments, and 13 two-bedroom apartments. This project will utilize deep incentives for affordable housing under Section 38.380.030.B.3 of the municipal code, including: 1. 38.380.030.B.3.d No minimum on-site vehicle parking requirement, but bicycle parking standards and requirements of 38.540.050 still apply. The project provides 36 parking spaces (28 on-site and 8 on-street) and exceeds bicycle parking standards with 97 spaces where only 11 are required. 2. 38.380.030.B.3.f(2) Section 38.510.030.E to J block frontage standards, provided that vehicle parking is prohibited between the front or side of a principal building and a public or private street. This project provides a 9-foot setback between the sidewalk and the front façade of the building where 10 feet is required. 3. 38.380.030.B.3.f(5) Section 38.530.050 building detail standards. The windows on the south façade do not provide trim or other design treatments around windows. Out of the 91 units, 46 units (10 studio, 29 one-bedroom, and 7 two-bedroom) will be designated as affordable housing, priced at or below 80% of the area median income (AMI). The property is located in the Neighborhood Conservation Overlay District and is zoned R-5 Residential Mixed-Use High-Density. While the existing structure contributes to a potential historic district, it is not individually classified as a historic structure. The City Commission denied application 23354, which included a demolition application, on July 9, 2024, citing non- compliance with Section 38.340.090C. Due to the previous denial, Section 38.340.090.D provides that issuance of a demolition permit is stayed for a period of two years from the date of the denial to allow the applicant and city to explore alternatives to the demolition. However, the two-year stay may be terminated at any point in time if an alternative proposal is approved or sufficient evidence is presented. The applicant has requested early termination of the two-year stay. If this application (24493) is approved, the stay will be terminated and a demolition permit will be issued.
