NOTICE OF A NEIGHBORHOOD CERTIFICATE OF
APPROPRIATENESS
This application is evaluated against the certificate of appropriateness criteria of section 38.230.080 of the Bozeman municipal code (BMC) and associated standards. Per 38.230.080.B, BMC, approval is granted if all criteria are met. The public may comment in writing regarding compliance of this application with the required criteria. Comments should identify the specific criteria of concern along with facts in support of the comment. Per 38.250.030.B, BMC, issues not raised during public comment period may not be raised on appeal. During the notice period the City will continue review for compliance with applicable regulations. Summary: A proposal to construct a detached accessory dwelling unit on the rear of the property. The property is located within the Neighborhood Conservation Overlay District (NCOD) and is zoned R-2. A deviation is requested from 38.360.030.I to allow for the accessory structure to be set back 4.8 feet from all property lines where 6 feet is required. The ADU is located on the rear of the property. Properties within the NCOD can request deviations from underlying zone districts per 38.340.070. The deviation request does not exceed the 20% threshold therefore the decision authority is administrative as outlined in 38.200.010.
