Middle Creek Ditch Company has NOT entered into any negotiations with Range 5 or 2B
Holdings LLC. 2B Holdings LLC asserts that MCDC has abandoned all claims to the ditch onthe east side of Fowler Lane. This assertion is false. This MCDC has NO record of any
abandonment of any ditches for this application. Buffalo Run paid for the abandonment of theditch only in front of its development and nothing more.
The City of Bozeman has no right to use or interfere with the Middle Creek Ditch CompanyPerscriptive Easements without written permission. In the plans given to the MCDC it appears
that the City of Bozeman storm drain goes into the MCDC ditch on the east side of FowlerLane at Apex Drive. Those plans do not include the construction drawings of the offsite
expansion of 27th Street. 27th Street is where the City of Bozeman paved over a MCDC ditchwithout permission. Application 23306 needs to be denied until all issues, including
stormwater dumping are resolved.
