That could be an option. Regarding the existing well, you will most likely want to withdraw the current water right and file a new one for all of the landscaping. If you could budget the two needs between two wells, that could work – you just can’t exceed 10 AF on wells within that property (unless you do the spacing, like you mention). We’re working on a new site plan application for 4840 Fowler Lane in south Bozeman (concept site plan attached) and was hoping to get your guidance on a few items. The 20.5-acre parcel has an existing house with an existing well/water right (also attached). The proposed development is all rental units so no subdivision is propose. The project would demolish the existing house but the plan would be to utilize the existing well to irrigate the on-site private landscaping. The landscape architect is running the numbers but we anticipate being under the 10 acre-ft limit for irrigating on-site landscaping. The City Park on the east side of the property will be dedicated to the City of Bozeman via easement. The City requires their parkland to be on an entirely independent irrigation system from any private irrigation networks. I don’t believe we’ll be able to irrigate both the City Parkland and private landscaping and stay under 10 acre-feet. Do we need to go through a process to redefine the existing well such that it is an exempt well subject to the 10 acre-ft/35 gpm limitations? Is there any avenue for this site to have two exempt wells in order to have 10 acre-ft from the existing well to irrigate the private landscaping and develop a new well to have an additional 10 acre-ft to irrigate the City Parkland? We wouldn’t be able to get ¼ mile of separation from the existing well but we could get the required separation if we abandon the existing well and install 2 new wells at opposing corners of the property. Are we able to go through the DNRC Predetermination process even though no subdivision is proposed? I’m happy to discuss any time. Thank you for your help!
