If there’s stormwater discharge to the ditch currently that conveyance will need to be maintained somehow. Agreed that the facility is a ditch and not a watercourse. Will need easement for drainage, perhaps irrigation. I’m working on a new site plan on the recently annexed 4840 Fowler property which is just west of Gran Cielo I. There is a ditch/watercourse on the east side of the property which, to my understanding, all water rights have been abandoned (I believe that Buffalo Run worked to abandon all remaining rights). This ditch runs through the west side of Gran Cielo in the back of the single-family lots on the west end. We have not observed water in this ditch this spring nor in the late summer/fall of 2022. It appears that the stormwater pond in the northwest corner of Gran Cielo discharges to the ditch. My interpretation is that this ditch/watercourse would not be subject to the 50-ft watercourse setback as it appears to be fully controlled by irrigation facilities (that are likely abandoned now), does not see natural water/seepage (no water has been observed in the ditch this spring even with the very high groundwater levels being observed across the City), and was not considered jurisdictional for the recently platted Gran Cielo Subdivision (no setback was applied to this ditch, single family lots are platted adjacent to the ditch). Would you agree with this analysis? We are planning to keep the ditch open regardless and the proposed site plan has it running through a proposed City Park on the east side of the site (rough concept attached). The only planned disturbances to the ditch will be from extending Bennett Blvd and Apex Drive to maintain the local street grid in the area.
