The property of interest is 115 acres comprised of 3 parcels at (approximately) 5300 Davis Lane, Bozeman, MT. The legal description of the three parcels are: • Section 27, Township 1 South, Range 5 E, Acres 22.847, PT of NE4NE4, E2E2W2NE4 south of ROW (Geocode 06-0904-27-1-01-10-0000), • Section 27, Township 1 South, Range 5 E, acres 56.81, W2W2NE4, W2E2W2NE4 less HWRW (Geocode 06-0904-27-1-01-20-0000), and • Section 27, Township 1 South, Range 5 E, acres 36.05 (Geocode 06-0904-27-1-02-01-0000). Government records and databases within the appropriate radii from the property of interest were searched for recognized environmental conditions, controlled recognized environmental conditions, historical recognized environmental conditions, and de minimis conditions. A site visit and interviews were also conducted. No recognized environmental conditions, controlled recognized environmental conditions, historical recognized environmental conditions or de minimis conditions were found upon the site. This Phase I ESA has been performed in conformance with the scope and limitations of American Standard for Testing Materials (ASTM) Practice E 1527-13 Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM, 2013). Any analyses, reports, factors or items not explicitly listed are excluded from Hyalite Environmental’s scope of services. Hyalite Environmental did not analyze any property not specifically identified. The findings and conclusions generated or produced in this assessment are intended exclusively for the use of Virga Capital, Bozeman, MT, and any parties appropriately designated by Virga Capital, Bozeman, MT. 2 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 1.0 INTRODUCTION Hyalite Environmental, LLP, has performed a Phase I Environmental Site Assessment (ESA) for a property in Bozeman, MT. The property of interest is 115 acres comprised of 3 parcels at (approximately) 5300 Davis Lane, Bozeman, MT. The legal description of the three parcels are: • Section 27, Township 1 South, Range 5 E, Acres 22.847, PT of NE4NE4, E2E2W2NE4 south of ROW (Geocode 06-0904-27-1-01-10-0000), • Section 27, Township 1 South, Range 5 E, acres 56.81, W2W2NE4, W2E2W2NE4 less HWRW (Geocode 06-0904-27-1-01-20-0000), and • Section 27, Township 1 South, Range 5 E, acres 36.05 (Geocode 06-0904-27-1-02-01-0000). Figure 1 shows the site location relative to Bozeman on an aerial photo of regional scale. A close-up aerial photograph of the site is shown on Figure 3. The site has no permanent structure (is vacant). There are fencing and utilities on the parcel. There are also culverts and structures related to the water courses. The purpose of the environmental site assessment is to perform "all appropriate inquiry into the previous ownership and uses of the property consistent with good commercial or customary practice" as defined in 42 USC 9601(35)(B). The goal of the Phase I ESA is to identify recognized environmental conditions that would indicate the presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to any release to the environment; (2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment. This Phase I ESA has been performed in conformance with the scope and limitations of American Standard for Testing Materials (ASTM) Practice E 1527-13 Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM, 2013). The Phase I ESA was conducted at the request of Virga Capital, Bozeman, MT. 3 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 2.0 USER PROVIDED INFORMATION Rob Lateiner (Manager, Virga Capital -- Purchaser) represents the user of this Phase I ESA. The User Questionnaire form suggested for use by the Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM, 2013) is included in Appendix D. The user has no knowledge of any environmental liens filed or recorded against the property of interest. The user is not aware of any Activity and Use Limitations (AULs) that are in place on the site or that have been filed or recorded. Environmental liens and AULs have been investigated by the title insurance company, Security Title Company. The user has no specialized knowledge or experience related to the property. The user believes that the purchase price is aligned with the fair market value of property in the area. The user is not aware of the past uses of the property, and does not know of any specific chemicals present, spilled, or released at the property. The user does not know of any environmental cleanups that have taken place at the property. The user is not aware of any obvious indicators that point to the presence or likely presence of releases at the property. Hyalite Environmental accepts no liability or responsibility concerning the information that is provided by the User for this Phase I ESA. 4 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 3.0 RECORDS REVIEW Supporting information for the records review is included in Appendix B. Historic Records are included in Appendix C, and Communication Records are included in Appendix D. 3.1 Regulatory Records Review Records were reviewed (record types and databases, pertinent search distances) according to Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM, 2013). The principal resource used was a report created by Environmental Data Resources, Inc. (EDR). That report and additional records are included in Appendix B. The locations of any sites listed by EDR as “un-mappable” or “orphan” were investigated by Hyalite Environmental professionals. The search radius required for each type of site differs according to the type of regulation, potential hazard, and regulatory agency. The following classification scheme organizes the search radius requirements in order of decreasing required search radius; each level of records review is from the defined required radius inward, and includes the subject property(ies). Required Records Search Radius of One Mile: 1. The search radius is one mile for Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). These sites are commonly referred to as Federal Superfund Sites and are listed on the National Priority List (NPL). 2. The search radius is one mile for State equivalent CERCLA sites. These sites are commonly referred to as State Superfund Sites. In Montana, the State Superfund enacting legislation is the Comprehensive Environmental Cleanup and Responsibility Act (CECRA) 3. Resources Conservation and Recovery Act (RCRA) Treatment, Storage or Disposal (TSD) facilities that have had a corrective action are required to be noted if within one mile from the parcel of interest. The common acronym for these sites is CORRACTS. Required Records Search Radius of One-Half Mile: 1. Federal sites listed in the CERCLA Information System (CERCLIS) including delisted NPL sites or sites that have been assigned a No Further Remedial Action Planned (NFRAP). 2. RCRA TSD sites that have not had a corrective action are to be noted if within one-half mile of the proposed parcel of interest. 3. The search radius is one-half mile for Solid Waste Landfills (SWLFs). 4. The search radius is one-half mile for Leaking Underground Storage Tank (LUST) sites. 5. The search radius here is interpreted to be one-half mile for Montana Water Quality Act sites (WQA) that are comparable to LUST sites with impacts that include chemicals other than petroleum hydrocarbons. 6. The search radius is one-half mile for State and tribal Brownfield sites. Required Records Search of Adjoining Properties: 1. Records for adjoining property are searched for Underground Storage Tanks (USTs). 5 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 2. Records for adjoining property are searched for RCRA generators. These sites may be Large Quantity Generators (LQG), Small Quantity Generators (SQG), or Conditionally Exempt Small Quantity Generators (CESQG). RCRA Non-Generator sites are those which handle hazardous materials but do not generate any waste. Required Records Search of Subject Properties: 1. Records are searched for the parcel of interest for toxic chemical releases. 2. Records are searched for the parcel of interest for institutional/engineering controls. 3.1.1 Facilities within One Mile of the Site of Interest The area within one mile of the property of interest is shown on Figure 2a. There are no active NPL sites that fall within one mile of the parcel of interest There are no active State Superfund (CECRA) sites within one mile of the parcel of interest There are no closed NPL or CECRA sites within one mile of the parcel of interest. The Bozeman Solvent CECRA Site is located greater than 1 mile from the parcel of interest, and the Controlled Ground Water Area (CGWA) associated with the plume of impacted groundwater from that site is greater than 1 mile of the parcel of interest. It is shown on materials in Appendix B. The Bozeman Solvent Site CGWA does not present a potential risk to the parcel of interest. There are no RCRA TSD or CORRACTS facilities within one mile of the parcel of interest. 3.1.2 Facilities within One-Half Mile of the Site of Interest The area within one-half mile of the parcels of interest is shown on Figure 2a. There are no delisted CERCLA sites within one-half mile of the parcel of interest. There are no RCRA TSD sites that have not had a corrective action within one-half mile of the parcels of interest. There are no recorded active or closed solid waste landfills (SWLFs) within one-half mile of the site. There are no active WQA sites within one-half mile of the parcel of interest. There are no active or inactive LUST sites within ½ mile of the parcel of interest. There are no Brownfields sites located within ½ mile of the project site. 6 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 3.1.3 Facilities Adjoining or within the Site of Interest The area adjoining or within of the parcel of interest is shown on Figure 2c and 3. There are no RCRA generators adjacent to or within the parcel of interest. There are no toxic chemical / hazardous material releases or institutional / engineering controls identified adjoining or within the parcel of interest. There are no active or inactive USTs on parcels adjoining parcels or the property of interest. There have been no hazardous materials spills reported adjoining or within the site of interest. 3.1 Vapor Intrusion The ASTM standard ASTM 1527-13 has included the assessment of vapor intrusion in the Phase I process by adding the definition of “migrate/migration”, which includes the movement of hazardous substances or petroleum products in any form. Based upon the extent of migration of impacts from known sites of groundwater impact, there is no known potential for soil vapor on site or vapor intrusion into site structures. 3.2 Ground Water The ground water flow direction is primarily down-valley (north), with westward flow influences on the east end of town (Slagle, 1995). Groundwater flow is complicated by local surface water features and local variations in the lithology of the unconfined aquifer (Slagle, 1995). There is no relevant publicly available data concerning ground water quality on the parcel of interest (MBMG, 2019). There is no publicly available shallow groundwater quality in the near vicinity of the site. Data from the CGWAs show that the parcel of interest is outside of the extent of the plumes of impacted ground water. There are no existing records of septic permits for the parcels of interest. The parcel at the Schaplow Farmstead, southeast of the parcels along Davis Lane is included in Appendix B. 3.3 Historic Records Information 3.3.1 Historic Data The parcel of interest is not covered by Sanborn Fire Insurance maps. 7 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 The parcel of interest was reviewed on aerial photos from the following dates (Appendix C): September 2020 July 2014 November 2011 September 2011 August 2006 July 2005 September 2005 December 2005 October 2004 August 2003 September 2003 August 1995 February 1985 (poor quality) These aerial photos confirm the history of the parcel gained from other sources: there has been no development on the parcels in the past. The parcels have been in agricultural production, likely since patent. 3.3.2 Title Records The Security Title Company examined recorded documents for the property (Appendix C). No Environmental Liens or Activity or Use Limitations were identified. Title records associated with the property were reviewed, and the current property owner provided information concerning previous owners (Appendix C). There were no indications of land uses of concern indicated on these records. 8 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 4.0 SITE RECONNAISSANCE Hyalite personnel performed a site visit of the property on April 17, 2021. The site reconnaissance was documented by photographs, which are included in Hyalite's project files. Representative site photos are included in Appendix A. A field investigation form documenting observations is also included in Appendix A. The parcel of interest is approximately 115 acres. Elevation ranges from approximately 4632 feet above mean sea level (amsl) on the southern boundary to 4595 feet amsl in the northwest corner (USGS, 2017; City of Bozeman LIDAR, 2015). There are no buildings on the parcel. An un-named tributary to Buster Gulch enters the site along the southern boundary approximately 430 feet from the SW corner of the site. It flows toward the northwest to the western boundary of the site about 950 feet from the SW corner of the site, then follows a course directly north along the western boundary of the site. Cattail Creek flows under Davis Lane from the west near the northern end of the eastern site boundary. It then rounds the northeast boundary corner and follows the northern boundary fence of the site for approximately 925 feet before crossing northward under East Valley Center Road. The Bozeman Gallatin Field weather station (240622) has recorded the average annual total precipitation as 13.92 inches (Western Regional Climate Center, 2021). The average maximum temperature is 84.6° Fahrenheit (F) in July; average minimum temperature 6.2° F in January. The average total annual snowfall is 47.0 inches, and the average snow depth in January is 4 inches. 4.1 Subject Property The site is vacant, bound by fencing on the north, east and west sides. Photos in Appendix A show that the field was recently tilled and sown. There is a center pivot irrigation system along the northern boundary. Irrigation water is conveyed in an above-ground pipe across fields south of the project site. At the southern boundary of the project site, the pipe is buried and crosses the project site northward to the center pivot underground. No items of concern were observed during the site visit. There was no visible evidence of incorrect handling, storage, use or disposal of hazardous materials or petroleum products. 4.2 Adjoining Property Land use adjacent to the property of interest includes agricultural, residential and a transportation corridor. The site is bound on the east by Davis Lane on the north by East Valley Center Road. The Schaplow farmstead is adjacent to the southeast corner of the site. There were no visible evidence of land use adjacent to the project site that indicated any incorrect handling, storage, use or disposal of hazardous materials or petroleum products on the parcels adjacent to the project site. 9 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 5.0 INTERVIEWS Hyalite personnel interviewed people with personal knowledge of the site and people with regulatory responsibility and potential knowledge of the site. Communication records of pertinent interviews are included in Appendix D. A list of persons contacted and interviewed is included in the table below. Table 1. Information provided by the interviewed persons indicated no ongoing or past condition related to use, storage, or disposal of petroleum or hazardous materials that would potentially impact human health or the environment on the property of interest. Worth noting, Don Vaniman explained that the parcels were used to land apply sludge from the Bozeman Wastewater Treatment Plant at one time. This apparently occurred pre-2011, when Barry Schaplow was managing agricultural operations on the parcel. Discussions with Tom Radcliffe, Superintendent of the Bozeman Wastewater Treatment Plant assured Hyalite that the land application was carried out following Environmental Protection Agency regulations, with appropriate testing of sludge and soils. There was no potential threat to human health or the 10 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 environment when application was ongoing, pre-2011. There would have been closure sampling and compliance monitoring when the site became dis-used, also evidence of no potential threat to human health or the environment. 11 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 6.0 EVALUATION Hyalite Environmental, LLP, has performed a Phase I Environmental Site Assessment (ESA) for a property in Bozeman, MT. The property of interest is 115 acres comprised of 3 parcels at (approximately) 5300 Davis Lane, Bozeman, MT. The legal description of the three parcels are: • Section 27, Township 1 South, Range 5 E, Acres 22.847, PT of NE4NE4, E2E2W2NE4 south of ROW (Geocode 06-0904-27-1-01-10-0000), • Section 27, Township 1 South, Range 5 E, acres 56.81, W2W2NE4, W2E2W2NE4 less HWRW (Geocode 06-0904-27-1-01-20-0000), and • Section 27, Township 1 South, Range 5 E, acres 36.05 (Geocode 06-0904-27-1-02-01- 0000). Findings and conclusions are provided below. 6.1 Findings Government records and databases within the appropriate radii from the property of interest were searched for recognized environmental conditions, controlled recognized environmental conditions, historical recognized environmental conditions, and de minimis conditions. There were no recognized environmental conditions, controlled recognized environmental conditions, historical recognized environmental conditions, or de minimis conditions at the site. Hyalite found no evidence of recognized environmental conditions during the environmental investigation that would indicate the presence or likely presence of any hazardous substances or petroleum products on the subject property under conditions that indicate any other existing release, past release, or material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater or surface water of the property. This Phase I ESA has been performed in conformance with the scope and limitations of American Standard for Testing Materials (ASTM) Practice E 1527-013 Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM, 2013). This Phase I ESA does not address asbestos-containing materials, radon, lead-based paint, wetlands, regulatory compliance, cultural and historic resources, industrial hygiene, health and safety, ecological resources, endangered species or indoor air quality. Any analyses, reports, factors or items not explicitly listed are excluded from Hyalite Environmental’s scope of services. Hyalite Environmental did not analyze any property not specifically identified. Hyalite Environmental was contracted through Virga Capital. The findings and conclusions generated or produced here are intended exclusively for the use of Virga Capital, and specific parties designated by Virga Capital. 12 Phase I Environmental Site Assessment Report Hyalite Environmental, LLP SW Corner of E Valley Center Rd and Davis Ln, Bozeman, MT April 2021 6.2 Opinion It is the opinion of the environmental professional that none of the conditions identified in the findings section have a significant adverse impact to the property. Potential environmental material threats identified within the property, adjoining, or within the approximate minimum search distance of the parcel of interest have been evaluated and determined to not likely present a serious potential environmental threat or significant adverse impact on the parcel of interest. It is the opinion of the environmental professional that no additional investigation is needed to detect the presence of hazardous substances or petroleum projects related to the property of interest. 6.3 Conclusions Hyalite has performed a Phase I ESA in conformance with the scope and limitations of ASTM Practice E 1527 for the southern 4 acres of the property located at (approximately) 5300 Davis Lane, Bozeman, MT. The legal description of the three parcels are: • Section 27, Township 1 South, Range 5 E, Acres 22.847, PT of NE4NE4, E2E2W2NE4 south of ROW (Geocode 06-0904-27-1-01-10-0000), • Section 27, Township 1 South, Range 5 E, acres 56.81, W2W2NE4, W2E2W2NE4 less HWRW (Geocode 06-0904-27-1-01-20-0000), and • Section 27, Township 1 South, Range 5 E, acres 36.05 (Geocode 06-0904-27-1-02-01-0000). Any exceptions to, or deletions from, this practice are described in Section 6.4 of this report. This assessment has revealed no recognized environmental conditions in connection with the property. 6.4 Deviations There were no deletions or deviations from ASTM Practice E 1527 in performance of this Phase I ESA. __________________________________________________________ 4/19/2021 Carol Lee-Roark, Ph.D., P.G.
