HomeMy WebLinkAbout24191 Revised Notice LIMITED SCOPE – PUBLIC NOTICE SITE PLAN APPLICATION The public notice has been reopened with a limited scope to ensure adequate opportunity for the public to comment and to provide additional time for reviewers and decision makers to review additional information received from the applicant. This public notice period is limited in scope to only the new information received since the close of the initial public comment period on September 17, 2024. A list of new or revised information is provided below, on which the City will receive public comment. This application is evaluated against the site plan criteria of Sec. 38.230.100. of the Bozeman Municipal Code (BMC) and associated standards. Per BMC Sec. 38.230.100.B and Sec. 38.230.120.C, approval is granted if all criteria are met. The public may comment in writing regarding compliance of this application with the required criteria. Comments should identify the specific criteria of concern along with facts in support of the comment. Per 38.250.030.B, BMC, issues not raised during public comment period may not be raised on appeal. During the notice period the City will continue review for compliance with applicable regulations. Project Name: 7th and Aspen Master Site Plan 7th and Aspen Phases 1 and 2 Site Plan Application: 24191 (Master Site Plan) & 24192 (Phases 1 & 2 Site Plan) Summary: A Master Site Plan and Site Plan application for the construction of a mixed-use development containing commercial and residential uses on three parcels over three phases located at 706 N 7th Avenue, north of W Peach Street, south of W Aspen Street, east of N 7th Avenue, and west of N 5th Avneue. Phase 1 will consist of a single 37,716 square feet four-story apartment building with 46 affordable rental dwellings in the center parcel and Phase 2 will consist of a single 37,716 square feet four-story apartment building containing 50 affordable rental dwellings on the southern parcel. Phase 3 of the Master Site Plan is a future phase anticipated to contain a single seven-story building with commercial space and approximately 75 market-rate units on the northern parcel. The applicant is currently exploring the feasibility of an interim surface parking lot on the northern parcel. The project proposes to utilize the deep incentives under BMC 38.380 Affordable Housing as the affordable units will consist of approximately 56% of the total dwelling units within the entire development. The requested deep incentives include: additional stories of height within all phases per 38.380.030.B.3.c; exemption from the special residential block frontage standards along internal pathways per 38.380.030.B.3.f.2; exemption from the maximum façade width standards per 38.380.030.B.3.f.3; and exemption from the roofline modulation standards per 38.380.030.B.3.f.4. Phases 1 and 2 will be accessed by a single existing vehicle approach off N 7th Avenue and the primary building entrances for both buildings will also be located on the west side along N 7th Avenue. A surface parking lot containing 23 spaces will be shared between buildings in Phases 1 and 2, and 6 on-street parking spaces are located along N 7th Avenue for a total of 29 parking spaces. The site is located within the Midtown Urban Renewal District which does not require a minimum number of parking spaces to be provided with the development per BMC 38.540.050.A.6.d. The applicant is requesting departures from four code sections: the minimum required building placement per the Landscaped block frontage standards in BMC 38.510.030.C; the light and air setback adjacent to the northern property line between Phases 1 and 3 per BMC 38.520.030.C; the required screening of ground related service areas per BMC 38.520.070.B.3; and a reduction in usable open space by 20% per BMC 38.320.070 Departures for housing creation. Additionally, this application includes associated design and infrastructure improvements pertaining to open space, vehicular and bicycle parking, landscaping, irrigation, lighting, and pedestrian pathways.
