June 30, 2023 Bozeman Development LLC 899 W Foothill Blvd STE G Monrovia, CA 91016-1973 RE: Notice of Subdivision Development Bozeman Development LLC To whom it may concern: We are providing this letter to notice Bozeman Development LLC of the proposed subdivision development on properties located near an irrigation lateral believed to carry waters which are used to irrigate your property situated in in Section 26, Township 1 South, Range 5 East, further described as being in the South ½ of the Northwest ¼, containing 15.99 acres (less the highway right-of-way). The proposed Turnrow Subdivision project is located west of Davis Lane and south of East Valley Center Road and is situated in the northeast ½ of Section 27, Township 1 South, Range 5 East, Gallatin County, Montana. The property is described as containing three (3) parcels: 2 Parcels as described in Warranty Deed Document 2736653 in the Gallatin County Courthouse Records Single parcel described in Warranty Deed Document 2736654 in the Gallatin County Courthouse Records The proposed subdivision was previously annexed into the City of Bozeman and is currently zoned REMU. The development proposes a mix of residential, multifamily, and limited commercial uses. The current phase of development proposes 156 habitable lots, 14 open space lots, 3 parks, and 18 restricted lots within the 114.6-acre subdivision. This development is in the pre-application stage, and the current proposed configuration is shown in the attached sketch map for your reference. Potential impacts to the irrigation ditch which serves your property would likely occur due to the reconfiguration and expansion of Davis Lane at the intersection with East Valley Center Road. This includes potentially extending and/or reconfiguring existing culverts at the northwest corner of your property which provides conveyance of tailwater from the ditch on your property. Notice of development is being provided to you pursuant to the City of Bozeman Municipal Code Section 38.360.280. We respectfully request your written comments to this notice at your earliest convenience. The code allows 45 days from mailing of this certified letter for you to comment, if needed. Additionally, we request that you please pass this notice along to any other known or interested parties which may be affected or may require notice for the expected irrigation impacts and proximity to this existing facility.
