TRAIL CORRIDOR EASEMENT
Bozeman Trax Partners, LLC, GRANTOR(S), in consideration of one dollar ($1.00) and
for other and valuable consideration, receipt of which is hereby acknowledged, grants to the City
of Bozeman, a Municipal Corporation of the State of Montana, with offices at 121 North Rouse
Avenue, Bozeman, Montana 59715, GRANTEE, a perpetual trail corridor access easement for
the use of the public in, through and across a twenty-five foot wide strip of land situated in
Gallatin County, Montana, which is located on the following described property:
Tract 1-B of Certificate of Survey No. 2153A, located in the NW1/4 and the NE1/4 of
Section 36, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County,
Montana, according to the official plat thereof on file and of record in the office of the
County Clerk and Reorder, Gallatin County, Montana
The GRANTOR(S) agrees:
(1) to construct and maintain the trails in the easement at their own expense in
accordance with relevant City Ordinances, including, but not limited to, snow removal and all
major and minor repair work.
(2) To allow the City to make any and all inspections of the trails and land appurtenant
thereto as the City reasonably deems necessary.
(3) To allow the City, or its contractor, to install and/or modify trail wayfinding signage
if and when a citywide wayfinding program is established.
The GRANTOR(S) warrants that he is lawfully seized and possessed of the real property
described above, that he has and that he will forever defend the title of this property against the
claims of all persons.
The GRANTOR(S) further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR(S).
The terms, covenants and provisions of this easement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors and assigns of the
parties hereto.

EASEMENT - DESCRIPTION
A trail corridor easement located on Tract 1-B of Certificate of Survey No. 2153A, located in the NW1/4 and the NE1/4 of
Section 36, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County, Montana, according to the official
plat thereof on file and of record in the office of the County Clerk and Reorder, Gallatin County, Montana, being more
particularly described as follows:
Beginning on the easterly line of Lot 1-B, said Point of Beginning; thence, N 63° 22' 43" W, 20.92 feet; thence, N 26° 41'
56" E, 30.36 feet; thence along a curve turning to the right through 06° 31' 55", having a radius of 107.50 feet, and whose
long chord bears N 29° 54' 22" E, 12.25 feet; thence, N 33° 10' 19" E, 17.27 feet; thence, S 09° 40' 10" W, 62.46 feet to the
Point of Beginning. Containing 672 square feet, more or less.
