Rouse Ave, MT 59715, a Municipal Corporation of the State of Montana hereinafter GRANTOR and does hereby release and reconvey the following described easement unto Bozeman Trax Partners, LLC as follows: W I T N E S S E T H WHEREAS the GRANTOR is the legal record title holder of a Trail Corridor Easement situated across the following real property: Tract 1-B of Certificate of Survey No. 2153A, located in the NW1/4 and the NE1/4 of Section 36, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Reorder, Gallatin County, Montana. WHEREAS the above Trail Corridor Easement was granted by North Park Development Partners, LLC, by the following instrument: Trail Corridor Easement, recorded on December 10, 2020 at the Clerk and Recorder’s Office of Gallatin County, Montana (Document No. 2711978). WHEREAS no public utilities are located within the easement to be released and the vacation of the said easement will not adversely impact the GRANTOR’S or the Public utility companies interests. WHEREFORE, the GRANTOR does hereby release and reconvey to Bozeman Trax Partners, LLC, those portions of the Trail Corridor Easement located on the above described real property as set forth on the Exhibit attached hereto together with any right, title, or interest that the GRANTOR may have in said Trail Corridor Easement as set forth on the Exhibit attached hereto and incorporated herein by reference as though fully set forth and shown on the Exhibit. This reconveyance shall not affect the remainder of that easement shown on the Trail Corridor Easement, recorded on December 10, 2020 at the Clerk and Recorder’s Office of Gallatin County, Montana. (SEAL) ______________________________________ Notary Public for the State of Montana ___________________________________ (Printed Name) Residing at Bozeman, Montana My Commission Expires: / /20 050 SCALE:1" = 100' 10050 EXHIBIT A NORTH EASEMENT RELEASE- DESCRIPTION A release and reconveyance of easement located on Tract 1-B of Certificate of Survey No. 2153A, located in the NW1/4 and the NE1/4 of Section 36, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Reorder, Gallatin County, Montana, being more particularly described as follows: Beginning on the easterly line of Lot 1-B, said Point of Beginning; thence, N 63° 22' 43" W, 20.92 feet; thence along a curve turning to the right through 20° 42' 46", having a radius of 94.54 feet, and whose long chord bears N 33° 47' 28" E, 33.99 feet; thence, N 44° 08' 51" E, 10.82 feet; thence, S 09° 40' 10" W, 46.04 feet to the Point of Beginning. Containing 529 square feet, more or less.
