WHEREAS,theCityofBozeman receiveda petitionforannexationrequestingtheCity Commission to extendthe boundariesof the City of Bozeman so as to includean area of land containingapproximately1.06acres,locatedon thenorthsideofKagy Boulevard and thewest side ofWillow Way;and WHEREAS,thepetitionwas submittedby thelandowner on January18,2023 requesting theCityCommission toextendtheboundariesoftheCityof Bozeman;and WHEREAS,an annexation staffreport was prepared in accordance with the Commission's goalsand policiesforannexationand was presentedto theCommission on June 6, 2023;and WHEREAS,a publicmeeting on saidannexationpetitionwas duly noticedand heldon June 6,2023;and WHEREAS,theCitydidnotreceiveany writtenprotestfrom therealpropertyowners of theareatobe annexed;and Page 1 of3 DocuSignEnvelopeID:DCA8763D-35CE-4026-B2D2-136E40094DAC Resolution55501801&1805WillowWayAnnexation WHEREAS,theprovisionof availableservicesto saidtractsas describedisthesubject of an Annexation Agreement;and WHEREAS,theCityofBozeman isrequiredto annex adjacentpublicrightofway such asWillow Way;and WHEREAS,theBozeman CityCommission herebyfindsthattheannexationofthistract isinthebestinterestsoftheCityofBozeman and theinhabitants/ownersthereof. NOW,THEREFORE,BE IT RESOLVED by the City Commission of the City of Bozeman,Montana,that: Section1 Thatitisherebydeclaredthat,pursuanttoTitle7,Chapter2,Part46,Mont.Codes Ann.,the following-describedproperty,be annexed to theCityof Bozeman and thattheboundariesof said Cityshallbe extendedso astoembrace and includesuch approximately1.06acres,towit: Legal Description Those parcels described in Document Nos.2509637 and 2542963,which together comprise Tract 7 and Tract 8,Beatty'sSubdivision,[PlatE-26],accordingto the plat thereof,on fileand of recordin the officeof the Clerk and Recorder,GallatinCounty, Montana,except thatpart of said Tract 8 thatwas conveyed for streetrightof way accordingto Film 125,Page 385,and thatpartof theeast4.25 feetof Tract 11,Beatty's Subdivision,adjacenttosaidTract7 and Tract8,and theadjacentportionsofWillow Way and West Kagy Boulevard rightofways,and locatedintheSouthwest Quarterof Section 13,Township 2 South,Range 5 East ofP.M.M.,alldescribedas follows: BEGINNING at the northwest corner of Tract 7 of saidBeatty'sSubdivision;thence easterly091°30'00",assumed azimuth from north,315.62 feetalongthenorthlineof said Tract 7 and itseasterlyextensionto the eastrightof way lineof Willow Way;thence southwesterly204°15'33"azimuth 298.83 feetalongsaidrightofway linetothecenterline ofWest Kagy Blvd;thencewesterly270°57'39"azimuth 203.85 feetalongsaidcenterline; thence northerly001°24'44"azimuth 277.48 feetalong the west property lineand its Page 2 of 3 DocuSignEnvelopeID:DCA8763D-35CE-4026-B2D2-136E40094DAC Resolution55501801&1805WillowWayAnnexation southerlyextension;thence easterly091°30'00"azimuth 4.25 feetalong the westerly extensionof thenorthlineof Tract7 tothePointofBeginning, Area of Lots =46,173 squarefeet,1.0599 acresor 4,289.6squaremeters.
