RESOLUTION 5492 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,PROVIDING FOR THE ANNEXATION OF CERTAIN TRACTS OF LAND, HEREINAFTER DESCRIBED,TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO INCLUDE SAID TRACTS,KNOWN AS THE WALKER SUBDIVISION LOT 5,BLOCK 1,ANNEXATION,APPLICATION 22125. WHEREAS,the City of Bozeman received a petitionfor annexation from William Thompson requestingthe CityCommission to extendtheboundariesofthe CityofBozeman so as toincludean areaoflandcontainingapproximately2.552acres,locatednorthwestoftheintersection of Campbell Road and Gibson Drive;and WHEREAS,an annexation staff report was prepared in accordance with the Commission'sgoalsand policiesforannexationand was presentedtotheCommission on November 15,2022 and continuedto December 20,2022;and WHEREAS,a publicmeeting on saidannexationpetitionwas duly noticedand held on November 15,2022 and December 20,2022;and WHEREAS,theCitydidnotreceiveany writtenprotestfrom therealpropertyowners of theareatobe annexed;and WHEREAS,on March 26,2024,the Commission receivedthe executed annexation agreementaddressingallrecommended terms ofannexation;and Page 1 of3 DocuSignEnvelopelD:214064EB-A5E7-4190-B898-E40F044A5314 WHEREAS,the provisionof availableservices,including,but not limitedto,streets, rights-of-way,easements,waterrightsor cash-in-lieu,waiversofprotestagainstcreationof SID's, and water and sewer hookup fees,to saidcontiguoustractsasdescribedisthe subjectof a written agreementbetween theCityand theLandowner;and WHEREAS,the Bozeman City Commission hereby findsthatthe annexationof this contiguoustractisinthebestinterestsoftheCityofBozeman and theinhabitants/ownersthereof. NOW,THEREFORE,BE IT RESOLVED by the City Commission of the City of Bozeman,Montana,towit: Section1 That itisherebydeclaredthat,pursuanttoTitle7,Chapter2,Part46,Mont.Codes Ann.,the following-describedproperty,which is contiguousto the municipal boundariesof the City of Bozeman,be annexed totheCityofBozeman and thattheboundariesofsaidCityshallbe extended so astoembrace and includesuch approximately2.552 acres,towit: Legal Description A parceloflandintheWalker PropertySubdivision,beingLot 5,Block 1,and theadjacent 60 footRight-Of-Way of Campbell Road,locatedinthe Southwest Quarterof Section25, and theSoutheastQuarterof Section26,Township 1 South,Range 5 EastofthePrincipal Meridian ofMontana,GallatinCounty,Montana,beingfurtherdescribedas follows: Beginning atthe SoutheastCorner of saidLot 5,Block 1,Walker PropertySubdivision.
