HomeMy WebLinkAboutResolution 2924 Master plan amendment, Urban Residential Infill on 10 acres - HRDC --_._~ ... .- , --,'" COMMISSION RESOLUTION NO. 2924 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE 1990 BOZEMAN AREA MASTER PLAN UPDA TE BY ESTABLISHING AN INITIAL LAND USE DESIGNATION OF "URBAN RESIDENTIAL INFILL" ON 10.0 ACRES LOCATED IN THE WEST % OF THE NORTHEAST % OF SECTION 11, TOWNSHIP 2 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN, GALLATIN COUNTY, MONTANA. WHEREAS, the City of Bozeman and the Gallatin County Commission have adopted a master plan, pursuant to Section 76-1-604, M.C.A.; and WHEREAS, the proposed master plan map amendment has been properly submitted, reviewed and advertised in accordance with the procedures set forth in Section 76-1-601 et seq., M.C.A., and the 1990 Bozeman Area Master Plan Update, dated October 1990; and WHEREAS, the City-County Planning Board held a public hearing on May 4, 1993, to receive and review all written and oral testimony on the request for the master plan map amendment; and WHEREAS, the City-County Planning Board recommended to the Bozeman City Commission that the requested master plan map amendment to establish an initial land use designation of "Urban Residential Infill" on 1 0.0 acres located in the West one-half of the Northeast one-quarter of Section 11, Township 2 South, Range 5 East, Montana Principal Meridian, Gallatin County, Montana, be approved; and WHEREAS, the City Commission held a public hearing on May 17, 1993, to receive and review all written and oral testimony on the request for a master plan map amendment; and WHEREAS, the City Commission has reviewed and considered the four criteria established in the 1990 Bozeman Area Master Plan Update, and found the proposed master plan map amendment to be in compliance with the four criteria; and WHEREAS, the City Commission has found that the proposed master plan map amendment to establish an initial land use designation of "Urban Residentiallnfill" would be the most appropriate designation for the subject property and would constitute an overall improvement to the Plan. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: ______n._ .-.--- _u_...__. ~. . .. ~~,~.,~i That the Master Plan Map (figure 8) to the 1990 Bozeman Area Master Plan Update is hereby amended by classifying the following-described 10.0-acre tract as "Urban Residential Infill": A tract of land located in the West half of the Northeast quarter of Section 11. Township 2 South. Range 5 East. Montana Principal Meridian. Gallatin County. Montana. and being further described as follows: Beginning at the Southeast corner of the West half of the West half of the Northeast quarter of Section 11. Township 2 South. Range 5 East. M.P.M.. thence East 20 rods; thence North 80 rods; thence West 20 rods; thence South 80 rods. to the place of beginning. containing ten (10) acres. less thirty feet off of the entire south end of said tract for highway. which is the extension of West Babcock Street. together with all water, water rights. water ditches, water privileges and all other rights appurtenant thereto, located in the County of Gallatin State of Montana. PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 19th day of July 1993, and effective the 2nd day of September 1993.
