WestMainFlats.comWest Main Flats is the eastern and southern neighbor of 2320 West Babcock Annexation and
Zone Map amendment Application 24106I do not have any reservations about this property being annexed into the city of Bozeman.
I do have reservations about the rezoning of the property.After talking to the staff at the Bozeman Planning Department, they showed me that the
building code for Residential Emphasis Mixed Use rear set back is not defined.The 2320 West Babcock Street Annexation Map shows that the rear property line is right on
the edge of our parking lot located south of the Babcock property.The Aerial view of the property with the red boundary lines is inaccurate since it shows that
the boundary line is right on the edge of the existing buildings.I would request that the request for Annexation and Zone Map Amendment be approved with
a stipulation that the rear set back be defined as 10 feet as is present in other zoning options.This set back would allow for water or snow coming off a roof to not have a negative impact
on the parking lot that is adjacent to the property and on the property line.Thank you for including this stipulation of defining the rear set back of 10 feet in the approval
of this application.Bret Niedens
