Good afternoon, sir.
Campers often quickly filter back in once we’re done sweeping, so I understand your skepticism. I
was on site for the 2023 cleaning but did not take any photos.
I also respect your discomfort mowing in the vicinity and do not mean to hand-waive those
concerns, but that falls outside my authority for requiring them to move.
We have to balance staff time and number of cleanups, as they often take up substantial effort and
pull resources away from the greater community. If we decide to take on a full clean this summer, I’ll
do my best to pull staff for mowing.

Hi Nick,
I’ve seen street cleanups on equestrian, but I have never seen them require all the campers to move
since they have taken up that street. Do you have any documentation or photos to show that
Equestrian was completely cleared of campers in 2023? And if they haven’t made them move in
2024, then aren't we overdue for a street cleaning. They’re all supposed to be moving every month
anyway according to ordinance 2147.
I AM requesting that the campers move while I work there. I don’t want to be mowing right next
to the campers and all the junk they have out on the right of way. If you’re unable to clear the
campers for me to work there, then why don't you have the city staff mow from the curb to the
property line. Then my no trespassing signs will be clearly visible from the street.
If the city has no means to enforce their own camping ordinance, then why can’t you clean the
streets once a month and have the campers move? I also don’t think anybody can say it’s
unreasonable to ask that the streets be cleaned once a month in the areas where there are campers.
Please take my comments into consideration.

I want to make sure I understand your request since context can get lost through text, so thanks in
advance for your patience.
The city can enforce the “manner” provisions within the camping ordinance such that belongings
would be removed from the ROW and not impede mowing, but I read your request explicitly as one
to remove the campers themselves from Equestrian. I responded to that request accordingly. If
there would happen to be no curb frontage available from the public ROW to access the parcel in
question, then I would agree that a camper would need to be relocated so that access can be
achieved.
The city has moved campers from Equestrian once in 2022 and once in 2023 for street sweeping and
conducted numerous cleanups from the campers themselves. There is no pavement maintenance
scheduled for Equestrian and the city previously restricted camping to one side of the street such
that winter maintenance activities can occur. Snow removal, sweeping, and pavement maintenance
are generally the maintenance activities that our Streets Division performs.

I need access to clear the weeds in the right of way, so the signs are easily visible from the street.
How do you expect somebody to get in there with a machine and mow down those weeds when the
campers have all their belongings out in the right of way? I plan on bringing this up at the meeting
tonight.
Why did the campers over near the interstate need to move for Cleaning, while people have been
camping on equestrian street continuously for years and the street has never been cleared for
cleaning or maintenance?

Hi Nick,
I still haven’t heard back from you. I’m going to be installing more no trespassing signs for the
owner, Rick Faber. Rick told me that he got a warning from the city that the field needs to be
mowed down and he also told me that his landscaper doesn’t want to do it while the campers are
there. I don’t think this is an unreasonable request to get those campers moved. I also don't want
to have to work around these campers to install the signs. Please get back to me.

This response is in acknowledgment of your request.
My understanding of the applicable laws and regulations is that a property owner certainly holds the
right to post their property from trespassing, but that right does not extend to the public right of
way. Signage can be placed within their property, but not within the public right of way. The city
does not have an obligation to mow public right of way outside of the curb line.
Please allow time for me to discuss with the City Manager Monday morning before responding
further.

Hi Nick,
I spoke with Deputy Nye from the sheriffs department. They're getting ready to take some action
against the campers. He wanted the landowners to post, prominent no trespassing and no camping
signs on their property. In order to put a sign up on the property, the weeds need to be mowed
down. In order to mow the weeds down, those campers need to move. I posted the current signs
for Rick Faber. And I might be the one posting the new signs as well.
I'm requesting that you clear all the campers from equestrian. I understand that there is 12 feet
of public right of way along equestrian. Is it the cities responsibility to keep that area clear of the
overgrown weeds?
