Olive Street Bozeman, MT 59715 RE: CONCURRENT CONSTRUCTION PLAN FOR THE 8TH AND ASPEN MIXED-USE BUILDING TD&H ENGINEERING JOB NO. B23-090 Dear Suzie, This narrative presents the concurrent construction plan for the 8TH and Aspen Mixed-Use Building project to demonstrate how on-site buildings and improvements can be constructed concurrently with the required off-site public infrastructure improvements in accordance with the requirements of BMC 38.270.030.D. This plan is being prepared pursuant to BMC 38.270.030 “Completion of Improvements” which states that municipal water systems, sewer systems, stormwater systems and streets providing service to a lot or site shall be constructed and accepted by the City prior to the issuance of any building permits, except when concurrent construction is identified and approved as a purpose of the initial project review. The 8TH and Aspen Mixed-Use Building project is located at the northeast corner of W. Aspen Street and N. 8th Avenue and consists of a new multi-story residential and mixed-use building in Bozeman’s Community Business District-Mixed (B-2M). As an infill project, some of the required infrastructure (i.e. water main) already exists adjacent to the site. However, an off-site sewer main replacement and upsize is required to serve demands from the new development as well as new street and alley construction and new stormwater infrastructure. The public infrastructure improvements associated with this project include (see also the attached project infrastructure overview sheet): • Construct N. 8th Ave. - W. Aspen St. to W. Juniper St. (local street section) • Construct W. Aspen St. - N. 7th Ave. to N. 8th Ave. (local street section) • Construct intersection pedestrian improvements – 7th and Aspen • Construct alley improvements - adjacent to property • Install N. 8th Ave. sidewalk & boulevard (east side only) • Install W. Aspen St. sidewalk & boulevard (both sides) March 27, 2024 PAGE NO. 2 tdhengineering.com • Install street lights - N. 8th Ave. intersections • Replace, re-route & upsize new 10" Sewer - W. Aspen St. to W. Birch St. • Install new storm drain and stormwater facilities • Adjust existing fire hydrants to grade The proposed infrastructure improvements will be designed and constructed according to the City of Bozeman’s Design Standards and Specifications Policy (DSSP), Montana DEQ Circular-2, the Montana Public Works Standard Specifications (MPWSS), and the City of Bozeman’s Modifications to the MPWSS. All of the proposed public improvements will be wholly located within publicly dedicated right-of-way and will have adequate capacity to provide service to the proposed development and adjacent contributing areas. It is understood that the final engineering design must be approved by the City Engineering Department and Montana DEQ prior to the issuance of any building permits for the project. It is also understood that no occupancy permit can be issued prior to the completion and final acceptance of the public infrastructure improvements. Construction of improvements at the site is currently expected to start in the summer of 2024 and will continue through 2026. The off-site infrastructure improvements will go out for public bidding in the spring of 2024 with the plan to complete the sewer main replacement street construction work in summer 2024. Some street improvements adjacent to the building like curb & sidewalk will likely be completed closer to the end of the project. Public water mains are already looped within the W. Aspen Street and N. 8th Avenue rights- of-way adjacent to the site. Fire protection services during building construction can be provided by existing fire hydrants #223, #1367 and #1368. According to the City’s operations & maintenance database, all three of these hydrants were flowed in 2022 and last inspected in 2023. Hydrant #223 can be readily accessed at the corner of N. 7th Ave. and W. Aspen Street. Please refer to the contractor’s attached site utilization maps to see project phasing and how emergency access to the site and access to hydrants #1367 and #1368 is proposed to be maintained throughout construction in coordination with proposed staging and material laydown areas. The following summarizes how all requirements of BMC 38.270.030.D are being met: 1. The site plan for the development is being reviewed as application #24051. 2. The property owner will enter into an improvements agreement with the City including securities and cost estimates as needed to ensure the installation of the required infrastructure. 3. The infrastructure improvements will be completed within two years of the date of the improvements agreement. 4. The engineering design will be submitted for approval by the City of Bozeman and Montana DEQ. It is understood that building permits cannot be issued prior to the plans being approved. March 27, 2024 PAGE NO. 3 tdhengineering.com 5. No incremental building permits or phases are currently proposed for this single building development. 6. The developer will provide and maintain hazard and commercial general liability insurance naming the City of Bozeman as additionally insured. 7. The developer will send correspondence recognizing, acknowledging, and assuming the increased risk of loss possible because certain public services do not exist at the site. 8. An application for public has been submitted to complete the public infrastructure improvements, including funding from the Midtown TIF District. The public funding sources will be identified in the final improvements agreement. 9. No occupancy or commencement of uses at the site will occur until the infrastructure improvements are completed, inspected, and accepted by the City and a certificate of occupancy issued. 10. No interim construction services are expected to be required from the City. 11. The developer will execute the City’s standard concurrent construction of infrastructure hold harmless agreement. 12. While none are anticipated, it is understood that the City may impose additional fees for any extraordinary costs which the City may identify associated with administering, overseeing, or inspecting the project and infrastructure improvements. 13. The development and all public infrastructure work will be under the control and supervision of a single general contractor through project completion. 14. This concurrent construction plan is intended to demonstrate how this project will address all requirements of BMC 38.270.030.D. We will have a minimal staging area to theWest of the site, but most material storage will be done office untilconcrete podium work is complete. We will then utilize the parkinggarage for staging and material storage. We are evaluating the useof 2 cranes, and/or a crane remobilization based upon ourconstruction needs. This will be dialed in once the constructionplans are completed and we have engaged a trade partner for thisscope. Fire lane access will be maintained around the new buildingand we will ensure the fire department has access to the extghydrant within our site at all times.
