STRATEGIC PLAN:
1.2 Community Engagement:Broaden and deepen engagement of the community in city
government,innovating methods for inviting input from the community and stakeholders.
4.A Well-Planned City:We consistently improve our community’s quality of life as it grows and
changes,honoring our sense of place and the ‘Bozeman feel’as we plan for a livable,affordable,
more connected city.
4.1 Informed Conversation on Growth:Continue developing an in-depth understanding of how
Bozeman is growing and changing and proactively address change in a balanced and
coordinated manner.
4.2 High Quality Urban Approach
c.)Parking Management by District:Develop a comprehensive,integrated approach to
parking management for the downtown,midtown,university,and other districts.Consider a
range of solutions including both on-street parking and parking Garages.
BACKGROUND:
During the regularly scheduled INC meeting on June 13th,2024,Chair Cynthia Evans
scheduled a special meeting on June 20th,2024 for INC to receive a presentation from
the Midtown Neighborhood Association (MNA)regarding Redevelopment Impacts to
Existing Northside Neighborhoods.The meeting agenda was publicly noticed on June
17th,2024 with supporting documentation containing a recommended motion:
Having received and considered the Midtown Neighborhood Association Steering Committee’s
presentation,materials in the development application #23354 file,and any public comment,I
move to send a letter to the City Commission requesting they:
1.)Deny development application #23354.
2.)Adopt a resolution requiring the establishment of managed residential parking districts
for established neighborhoods that are in proximity to and can reasonably expect to be
impacted by any zoning,overlay district,or development proposal utilizing relaxed
parking minimums.
3.)Immediately rescind section 38.380.of the Bozeman Municipal Code and schedule a
work session to add clarity,address externalities,and establish a means for corrective
action in the event of unintended consequences.
On June 20th,2024,INC received a presentation from MNA steering committee members
summarizing their findings and substantiating the three parts of their recommended
motion.Public Comment was received,and representatives of the development
applicants,HomeBase partners,were present and able to participate in the Council’s
Q&A.INC moved and voted to reconvene the following week in order to engage with
their own respective neighborhood associations,distribute a survey,and assess the
individual bylaws thereof for the process by which a delegate can take a position on the
matter.
The June 27th,2024 meeting agenda was publicly noticed on June 24th,2024.During the
meeting,the results of the neighborhood engagement responses (over 200)were
discussed.and the recommended motion was approved with 5 members voting “yes”
and 4 “abstaining ”as a requirement of their associations’bylaws.

After reviewing agenda packet materials,receiving public comment and all information
presented during our June 20th,2024 meeting of the Inter-Neighborhood Council;after engaging
with Neighborhood Association members,conducting a survey of Association Membership,
reviewing over 200 responses,and receiving public comment during our June 27th,2024
meeting;
We,the Inter-Neighborhood Council,in our special capacity as a city charter-recognized
advisory board (Sec.4.06.),recommend the City Commission acknowledge the substantial
outreach response garnered by the Council,consider the recorded contents of the June 20th,and
June 27th Inter-Neighborhood Council meetings,consider the enclosed Neighborhood
Engagement Survey responses,and take the following actions in regard to Re-Development
Impacts on Existing Northside Neighborhoods:
●Deny Development Application #23354.“The Guthrie”(scheduled July 9th,2024)
○93.36%of survey respondents in favor
●Adopt a resolution requiring the establishment of managed residential parking districts
for established neighborhoods that are in proximity to and can reasonably expect to be
impacted by any zoning,overlay district,or development proposal utilizing relaxed
parking minimums.
○90.05%of survey respondents in favor
●Immediately rescind section 38.380.of the Bozeman Municipal Code and schedule a
work session to add clarity,address externalities,and establish a means for corrective

We recognize the many efforts the Commission,and,as an extension,our community is making
to mitigate the profound and acute changes affecting housing opportunities and economic vitality
of our citizens.In order to protect the integrity of these efforts and balance them with your
strategic efforts to keep neighborhoods resilient,livable,and safe,we appreciate you reviewing
and considering these recommendations.We welcome all stakeholders to engage with the
Council,and use our forum to collaborate proactively and efficiently on city-wide issues.

motivated to provide "affordable" housing as a way to give back to Bozeman.
However, what he really wants is a place for workers in his hotels and other
properties to find temporary housing that is close to downtown. He has been
struggling to fill positions in his organization because the low-end jobs don't pay
enough to rent here. So, this is really a way to serve himself, and squeeze a taller
building, with inadequate parking out of the deal via the supposed lower income
units. Note that this building is right next to the most vulnerable population of
elementary school kids in the area. So, parking issues, come-and-go tenants, etc.
will be impacting these kids who already have too much in their lives to distract
them from school. We should not allow the zoning code to hamstring us into
accepting this deeply manipulative project. Thank you!

and Villard is not providing what I consider “true” affordable housing. Planning
and development in Bozeman needs to slow down. Midtown’s requests are
completely reasonable and critical to slow down the impact of rampant
development that really only benefits the developer. I understand growth and the
need for affordable housing. These requests from Midtown will help with planning
and with development and with affordable housing development. Please support
these requests for Midtown and for every other neighborhood in Bozeman
impacted by the explosive and rampant growth and sprawl.

Homebase Partners is clearly taking advantage of it as it stands now. The studio
apartments they are designing without full kitchens are NOT affordable, and

delusional to think that people will ride share and not have cars, and the fact that
the city would grant this VERY profitable company these leniences, allowing them
to build this close to a school in a historic neighborhood, is unethical.

pushing the limits of what's reasonable. Those units are so small that they are
basically hotel rooms and still quite expensive. This won't provide affordable
housing for folks who live and work in Bozeman for the long haul. It's just
temporary housing for short term workers, which I don't believe is the intent of the
ordinance.

addressed as part of the plan. Additionally, more multi-million dollar condos
without parking, is not with the city needs. If anything is built in the midtown area,
it should reasonably comply with/support our increasingly dramatic need for
affordable housing, AND parking! If the city listens to residents, this build is not a
desirable option for anyone outside of the developer.

should truly be helpful to Bozeman citizens. The city commission should shift
focus and only approve "workforce" housing for the forseeable future. This needs
to be a much lower financial bar than "affordable". Workforce housing should
come in all sizes, from tiny homes and starter homes to tall midrise buildings and
everything in between. Landlords who provide truly affordable workforce housing
should be given significant incentives to keep up the good work.
Parking is an issue. I've always felt that dropping parking guidelines is the wrong
approach. It can and does come with negative impacts for surrounding
neighborhoods.
Under no circumstances should neighbors near large projects be permanently
saddled with the negative consequences those projects bring. Loss of sunlight,
loss of peace and quiet, loss of neighborhood character. It's all bad. Perhaps
developers should have to share their windfall profits with those they impact!

Gutherie seems to be), I'm not sure rescinding the ordinance is the right solution.
That will leave us with literally nothing to push developers to build some amount
of affordable housing. Given how long these things take to develop and adopt, I'd
rather start work to improve/ fix the existing ordinance while it is still in place. So,
I'd suggest amending this last bullet point to that effect.

city to court and win. 2) Some tweaks to the affordable housing ordinance may be

affordable rent. I would not be able to easily afford these apartments as a single
person. A studio apartment for two people also does not seem very reasonable
either. "Affordable" rent in my mind is $800/month for a single person. It is
expensive to live in Bozeman and if your rent costs $1600/month you have very
little leftover for your other bills, monthly expenses, and ability to have leisure
time. This also makes me worry these tiny units will all become airbnbs. I also
don't understand how many new housing projects in Bozeman are allowed to be
built in Bozeman without adequate parking provided. I understand the city wants
to encourage more walking and biking, but even if people may live close to
downtown not all of Bozeman is within walking distance, we also live in an
outdoor area which requires travel to trails and points of interest, and in winter
sidewalks can be quite dangerous. There should be a requirement to have at
least one space per unit in any new housing developments. People have cars,
this can't be ignored. Parking can be placed underground as well. Without
adequate parking provided the parking spill over goes into the existing
neighborhoods clogging parking for home owners and surrounding traffic. If these
things would change for the proposed development I would support the project.

household gross annual median income for housing.

Assumptions and Calculations
•To determine the maximum sales (?) prices of
affordable homes with different numbers of
bedrooms, the city will base its calculation on AMIs
for households of different sizes, as follows, with the
review authority determining which rooms qualify as
bedrooms:
•a. Studio dwelling: AMI for a one-person household;
•b. One bedroom dwelling: AMI for a two-person household;
•c. Two bedroom dwelling: AMI for a three-person household; and
•d. Three bedroom unit or larger: AMI for a four-person household.

Required -Development Standards for
Affordable Homes
•a. The number of affordable homes must meet or exceed the minimum standards needed to qualify for the applicable incentive in section 38.380.030.
•b. The mix of bedrooms per unit in affordable homes must be as similar as possible to the mix of bedrooms per unit of the market -rate homes in the development.
•c. Access to shared amenities and services by residents of the affordable homes must be the same as to those in market rate homes in the development.
•d. If the development is to be constructed in phases, and the developer has requested affordable housing incentives, at least 75 percent of the dwelling units in each phase must be affordable homes, unless the city has received adequate legal or financial assurance that any shortfall during earlier phases will be constructed before approval of the final phase of development.

Staff report on the Guthrie's plan
•Most of the units in the project are proposed as one-bedroom units. The BMC
does not contain a definition of the term, “bedroom.” Pursuant to BMC
38.700.010, where the BMC does not define a term, it must be defined as found in
the latest edition of "The Illustrated Book of Development Definitions" by Harvey
S. Moskowitz and Carl G. Lindbloom. The "The Illustrated Book of Development Definitions" (2015) provides a definition of a “bedroom”:
A private room planned and intended for sleeping, separated from other
rooms by a door, and accessible to a bathroom without crossing another
bedroom.
•Staff finds that all the units in The Guthrie meet the definition of a one-bedroom
unit for the purposes of assigning rental rates pursuant to 38.380.020.D.2.,
because sleeping areas may be separated from other rooms by a door, and these
sleeping areas are accessible to a bathroom without crossing another bedroom.
Doors provide privacy to the sleeping area from other parts of the apartments.
•Affordable homes are distributed throughout the building and nothing in the Site Plan
Application or Affordable Housing Plan indicates that any shared facilities will not be
available to all residents. The Applicant confirmed in writing that, “Access to project amenities and services are available for ALL residents.”
UDC does define "apartment"but

•A habitable room or suite of two or more habitable rooms
meeting the requirements of the city's adopted
International Building Code, located in an apartment
building or used for residential purposes in non-residential
buildings located within non-residential districts, as
specified in this chapter. An efficiency unit is as an
apartment under this definition. Townhouses and
rowhouses are excluded from this definition.

•“See Dwelling Unit, Efficiency”.
•A dwelling unit consisting of not more than one habitable room (emphasis added), together with kitchen or kitchenette and sanitary facilities.
o Comment: Efficiency units, also known as studio apartments, typically contain between four hundred and five hundred square feet. See Dwelling, Micro-Unit.

What does this mean?
By treating the operable partitions as doors and
thus classifying the units as one-bedroom instead of
studios, tenants will pay an extra $118,125 the first
year, with increasing amounts as AMI increases.

o Any room in a dwelling unit other than a kitchen (emphasis added), bathroom, closet, pantry, hallway, cellar, storage place, garage, or unfinished basement, cellar, or attic.
•What is a rooming unit?
o Any habitable room or group of rooms forming a single habitable unit, used or intended to be used for living and sleeping but not for cooking or eating (emphasis added).
•What is an amenity?
o A natural or created feature that enhances the aesthetic quality or visual appeal or makes more attractive or satisfying a particular property, place, or area.
•What is a viewshed?
•An elevated or unobstructed location, position, or area that permits an unhindered panoramic vista of particular interest or pleasure or unique view to or from a particular point. See Vista. See Figure 106.
•What is a micro-unit?
o A type of dwelling unit between two hundred fifty to four hundred square feet containing a kitchen, bathroom, and sleeping accommodations.
o Comment: The micro-unit is designed to provide affordable housing to single persons and couples. The size of micro-units differs by jurisdiction and purpose. Most cities usually have minimum area requirements for apartment housing (four hundred fifty square feet, for example) that would have to be changed if micro-units are to be permitted. Newer forms of “rooming houses” composed solely of micro-units are now being built to cater to young singles who want to live away from home in smaller, affordable units. The micros units in such modern rooming houses may be as small as one hundred to two hundred square feet, including a small kitchen and compact bath. See Micro Hotel.

Consider the motion:
Having received and considered the Midtown Neighborhood Association Steering
Committee’s presentation, materials in the development application # 23354 file,
and any public comment, I move to send a letter to the City Commission
recommending they
Deny development application # 23354.
Adopt a resolution requiring the establishment of managed residential parking
districts for established neighborhoods that are in proximity to and can
reasonably expect to be impacted by any zoning, overlay district, or development
proposal utilizing relaxed parking minimums.
Immediately rescind section 38.380. of the Bozeman Municipal Code and schedule
a work session to add clarity, address externalities, and establish a means for
corrective action in the event of unintended consequences.
