This is the time to comment on any matter falling within the scope of the Inter-Neighborhood
Council. There will also be time in conjunction with each agenda item for public comment relating
to that item but you may only speak once per topic.
Please note, the Board cannot take action on any item which does not appear on the agenda. All
persons addressing the Board shall speak in a civil and courteous manner and members of the
audience shall be respectful of others. Please state your name and place of residence in an audible
tone of voice for the record and limit your comments to three minutes.
Consider the Motion: Having received and considered the Midtown Neighborhood Association
Steering Committee’s presentation, materials in the development application # 23354 file, and any
public comment, I move to send a letter to the City Commission recommending they
Deny development application # 23354.
Adopt a resolution requiring the establishment of managed residential parking districts for
established neighborhoods that are in proximity to and can reasonably expect to be impacted by
any zoning, overlay district, or development proposal utilizing relaxed parking minimums.

Immediately rescind section 38.380. of the Bozeman Municipal Code and schedule a work session
to add clarity, address externalities, and establish a means for corrective action in the event of
unintended consequences.

STRATEGIC PLAN:
4.1 Informed Conversation on Growth: Continue developing an in-depth
understanding of how Bozeman is growing and changing and proactively
address change in a balanced and coordinated manner.
BACKGROUND:
On November 27, 2023, property owner Fifth and Villard Apartments, LLC
submitted an application for a commercial non-residential certificate of
appropriateness, demolition and site plan proposing “The Guthrie” building
(the “Application”). The application site is zoned R5 (residential mixed-use
high density) and is within the City’s Neighborhood Conservation Overlay
District (NCOD). The application proposed a five floor multifamily residential
building with a total area of approximately 64,860 feet and 111 residential
units including 56 as affordable units and relying on the deep incentives
provision at 38.380.030, BMC.
UNRESOLVED ISSUES:

In the beginning of March 2024, the application was publicly noticed.
On March 11th, neighborhood association member Noah Ten Broek reached
out to the applicant, Andy Holloran of HomeBase Partners to facilitate a
dialog regarding neighborhood concerns
On March 27th, the neighborhood association met with the developer at the
AC Hotel in Downtown Bozeman. Emily Talago, INC representative for
Midtown, announced she would be recording the meeting to ensure
notification and consent by the attendees. Audio recording of that meeting
was submitted into the public record.
On April 2nd, during general public comment of the Bozeman City
Commission meeting, over 40 residents spoke asking the commission to
consider reclaiming review authority.
From March 11th to April 8th (the duration of the noticing period) 166
written public comments were received, all against the project.
On April 16th pursuant to 38.200.010.B.2, the City Commission voted
unanimously to reclaim their role as review authority over the application.
On April 29th, 2024 The Midtown Neighborhood Association held their
annual meeting where concerns were expressed regarding the pace and
intensity of redevelopment.
On May 22nd, the Midtown Neighborhood Association Steering Committee
held a meeting during which they held a work session regarding the project.
The planning department then sent the application back to the developer for
an additional review cycle. On May 28th, 2024, the project was re-noticed.

STRATEGIC PLAN:1.1 Outreach: Continue to strengthen and innovate in how we deliver
information to the community and our partners.
BACKGROUND:INC Board Chair Emily Talago will lead the group in a discussion on the
following:
Using annual reports to synthesize a neighborhood "pulse." Chair
Talago would like to use these reports and a neighborhood
association-wide survey to inform and restart the annual "State of the
Neighborhoods" address to City Commission.
Setting a date for a summer social event.
