I would like to ask that each Commissioner state for the public record their position on the
proposal that would allow a developer to manipulate the City's Affordable Housing
Ordinance (AHO) so as to build a 7-story, luxury condo building but not build any affordable
housing. As per Agenda Item H.11 Authorize the City Manager to sign a task order eight
with Economic and Planning Systems (EPS) for the Miller Global Affordable Housing
Ordinance density bonus review."
And also answer the folloiwng questions:
1. What is a "Task Order Eight?" 2. Why would we even entertain such a proposal when
the developer is not actually proposing affordable housing? 3. As I read it, "The AHO is a
voluntary contractual incentive program." so we can voluntarily say no. 4. Paying someone
$19,100 to figure out if it's a good idea to use affordable housing incentives when no
affordable housing is actually being provided seems like a total misuse of funds/taxpayer
dollars to me. "Section 38.380.50 of the AHO provides the option of dedicating land to the
City rather than constructing units within the project. The Code states that the land donation
must “provid[e] equal or greater affordable housing benefit to the city”. So unless the
developer is going to donate land AND build ANOTHER building with actual affordable
housing units ready to go, then it would just cost us more money to build the actual
affordable housing units.
