Saturday, May 3, 2024; X:XXam Re May 7, 2024, Bozeman City Commission meeting: I am writing to ask the Commission to (1) move Consent Agenda Item H.11 to the Action Item Agenda, (2) explainthe details of this proposal (i.e., who, what, when, where, how, and why), and (3) state for the public record their respective positions on this proposal—which would allow a developerto manipulate the City's Affordable Housing Ordinance so as to build a 7-story, luxury condo building while not building any affordable housing. I note that Consent Item H.11 reads as follows: Authorize the City Manager to Sign a TaskOrder Eight with Economic and Planning Systems (EPS) for the Miller Global Affordable Housing Ordinance Density Bonus Review: "The City of Bozeman is reviewing a proposed use of the City’s density bonus offered through the Affordable Housing Ordinance (AHO) passed in October 2021. Miller Global (developer) is proposing a 7-story luxury downtown condominium development with 46 units. The developer is proposing to use the incentives offered in the City’s Affordable Housing Ordinance to gain an additional two stories above what the base zoning allows (5 stories). The developer is proposing to dedicate land to the City rather than constructing units within the project. This task order will allow Economic and Planning Systems (EPS) to determine if the proposed donation complies with the City's Affordable Housing Ordinance." Daniel Carty 213 N.
