Box 1230 Bozeman, Montana 5771-1230 RE: Harper's Corner Annexation /Zone Map Application 23127 PROTEST Dear Bozeman City Clerk: Please present this protest and opposition to annexation' and requested zoning designation of R-4. I am the owner of two (2) tracts of real property within 150 feet of this application being the owner of a parcel of land situated in Tract B of COS 415 located in the SW% of Section 27, T1S, R5E further described as Lot 4 of said tract as shown on Minor Subdivision 26 (film 74 pg 1747) and the tract located in the SW % of SW % of Section 27, T1S, RSE, with address of 1285 Hidden Valley Road and Geocode 06-0904-27-3-04-01-000. Please deny the requested zoning of R-4 (residential high density) for this application. As you are aware, the directly north and across the street is currently zoned AS Rural Residential by Gallatin County. Placing R-4 (high density residential zoning) directly adjacent to a zoning designation with the primary purpose of agricultural activities is a direct conflict. The purpose of the AS zoning is to provide for Agriculture Activities and rural residential uses on larger tracts of land and to maintain and preserve the rural character. High density residential development is not compatible with agricultural zoning. The law requires the City to authorize land uses comparable to the land uses authorized by county zoning pursuant to Section 76-2-303,(3) MCA. By considering and possibly approved such high density you will be automatically be in conflict with lots size, rural nature surrounding this annexation and force any future residents to endure the usual acknowledged impacts of agriculture, which is noisy, smelly and dusty. If I am reading the future land use map correctly, while the Harper's Corner request is within the City's Growth Policy Boundary, it is in the area that your Context Map acknowledges 'While it appears that the City Commission approved the annexation of this property in January of 2024, the title of the Amended Notice is "Harper's Corner Annexation and Zone Map Amendment". are parcels up to 20 acres and pursuant to the City's adopted Triangle Community Plan should be used to not contribute to sprawl, increased infrastructure service costs and premature conversion of agricultural lands and open space to mitigate the impacts of additional residential development. This property is beyond Bozeman's Accessibility and Mobility as represented in your Bozeman Community Plan 2020 as well as shown as Urban Neighborhood on the Future Land Use Map. It seems to me that the use of the term urban design and Goal N-1.5 urban agriculture, which would be more compatible with the existing land uses, is not aligned with the R-4 density sought. This density does not seem complementary to your stated Theme 3 of "Preventing sprawl and increasing resource efficiency depend on an intensity of urban life found in our commercial centers. Innovative design and planning include ideas like pocket neighborhoods, smaller housing, green alleys, urban agriculture, and creativity in our public spaces." Please do not set up our neighborhood for continual conflict. The City of Bozeman Community Plan 2020 requires the City to work with the County on land use planning issues. Considering R-4 next to agricultural zoning does not demonstrate any kind of"work with" or cooperation. To the extent that my voice is a protest.
