RE: SACCOCCIA MINOR SUBDIVISION 407C LOT 2A MINOR SUBDIVISION 2A1 2A2 PROJECT#21212 Hi Brian, I am writing in response to request by Karl Johnson regarding water rights transferfor the minor subdivision of Lot 2A of Saccoccia Minor Subdivision 407C, which willcreate a 3 acre Lot 2A1 with Home 2 hotel and a remainder 2 acre Lot 2A2. Copy ofWater Rights item from Karl's memorandum is below. The water rights in question isfor the 2 acre Lot 2A2. Usable water rights in the form of shares of Farmers Canal Irrigation District weretransferred in full and accepted by the City of Bozeman to satisfy this condition forfinal plat approval of Subdivision 407, as is documented in attachment from City ofBozeman files. Subdivision 407 included Lots 1, 2, 3, 4 and 5. Lots 1 and 2 boundaryrealignment created Lots 1A and 2A (Home 2 site) of 407C. Please confirm to Karl that usable water rights transfer to City was done for Lot 2Awhich includes both proposed Lot 2A1 and Lot 2A2. BMC Section 38.23.180 states: the transfer of water rights or the payment of cash-in-lieu (CIL) of water rights shall be provided. The applicate should contact Griffin Nielsen, with the City of Bozeman Engineering Department, for determination of payment. City of Bozeman emails are subject to the Right to Know provisions of Montana’s Constitution (Art. II, Sect. 9) and may be considered a “public record” pursuant to Title 2, Chpt. 6, Montana Code Annotated. As such, this email, its sender and receiver, and the contents may be available for public disclosure and will be retained pursuant to the City’s record retention policies. Emails that contain confidential information such as information related to individual privacy may be protected from disclosure under law.
