Olive Street Bozeman, MT 59715 RE: CONCURRENT CONSTRUCTION REQUEST FOR 811 WEST MENDENHALL APARTMENTS TD&H ENGINEERING JOB NO. B23-026 Dear Simon, The purpose of this letter is to formally request concurrent construction with the site plan application for the 811 West Mendenhall Apartments project to allow for on-site buildings and improvements to begin construction prior to the associated public infrastructure improvements being installed and accepted by the City. This request is being made pursuant to BMC 38.270.030.C and D which states that municipal water systems, sewer systems, stormwater systems and streets shall be constructed and accepted by the City prior to the issuance of any building permits, except when concurrent construction is identified and approved as a purpose of the initial project review. Specifically, it is requested that private development and public infrastructure construction be allowed to proceed concurrently under the provisions of subsection D for off-site improvements. The proposed public infrastructure improvements associated with this project include: • Replacement and upsizing of the existing 6-inch clay sewer main in N. 8th Avenue with a new 8-inch minimum diameter PVC sewer main. • Replacement and upsizing of the existing 6-inch cast-iron water main in N. 8th Avenue with a new 8-inch minimum diameter ductile iron main. • Installation of a new fire hydrant at the intersection of W. Mendenhall Street and N. 8th Avenue. • Installation of new curb & gutter along the entire project frontage, including a new curb bulb and ADA ramps at the intersection of W. Mendenhall Street and N. 8th Avenue, and a new concrete alley apron approach on W. Mendenhall. The proposed infrastructure improvements will be designed and constructed according to City standards, will be wholly located within publicly dedicated right-of-way or public utility easements, will be adjacent to the subject property, and will have adequate capacity to provide service to the proposed development. The water and sewer main replacements will extend off-site to connections in Lamme Street and Beall Street, respectively. Fire protection services during building construction can be provided by existing fire hydrant #’s 113, 114, 2431, and 2748 which are all within one block of the property, the closest being fire hydrant #2431 to the north. The site can be readily accessed via W. Mendenhall Street, N. 8th Avenue, and the alley on the west side of the property. This project intends to complete the site development concurrently with installation of the required public infrastructure improvements under a single developer and general contractor team. It is understood that the final engineering design must be approved by the City Engineering Department and MDEQ, in addition to meeting all the requirements of 38.270.030.D, prior to the issuance of building permits for the site. It is also understood that no occupancy permit shall be issued prior to the completion and final acceptance of the public infrastructure improvements.
