NOTICE OF AN ADMINISTRATIVE REVIEW
MINOR SUBDIVISION APPLICATION
This application is evaluated against the Minor Subdivision Review provisions of Section 76-3-609, MCA and minor
subdivision preliminary plat criteria of section 38.240.130 of the Bozeman municipal code (BMC) and associated standards.
Per 76-3-609(6) MCA, approval is granted if the application: is located in an area that is subject to and complies with all
zoning regulations adopted pursuant to state law that address development intensity through densities, bulk and
dimensional requirements (e.g. development standards found in Chapter 38 of the Bozeman Municipal Code), and land use
standards; has a will-serve letter for municipal water and sewer service or through a county water and/or sewer district; has
existing legal and physical access to each lot; and does not require a variance to any subdivision regulations required in
76-3-504(1)(g) MCA.
The public may comment in writing regarding compliance of this application with the required criteria. Comments should
identify the specific criteria of concern along with facts in support of the comment. Per 38.250.030.B, BMC, issues not raised
during public comment period may not be raised on appeal. During the notice period the City will continue review for
compliance with applicable regulations.

construction (Projects 22324 and 23043). The property is zoned REMU, Residential Emphasis Mixed Use.
