Tue, Apr 9, 2024; 10:05am To: City Commission Subject: Commission meeting 4-9-24; Action Item K.1: Ordinance 2159, Prohibition ofparking in bike lanes I am writing to ask the City Commision to provisionally adopt Ordinance 2159 Prohibition of Parking in Bike Lanes because such a prohibition will help make life a bit safer for all of usroad bicyclists in Bozeman. That said, the following proposed language in Ordinance 2159 seems a bit excessive with respect to a first violation for parking in a bicycle lane: Sec. 36.04.380. Enforcement; penalty for violations. A. Fines. A violation of this articleshall be punishable by a penalty and the penalties shall be imposed as follows: 3. The minimum penalty for parking in violation of section 36.04.030.A.1-15 and36.04.030A.17 shall be a fine of not less than $50.00 or more than $300.00." I suggest modifying the proposed language above to include a written warning for a first violation for parking in a bicycle lane—if such an option is not already at the discretion ofthe City's Parking Division and other law enforcement entities—followed by a $50.00 to $300.00 fine for subsequent violations.
