Subject: Please reclaim The Guthrie (Application No. 23354) from administrative-only
review.
I am writing to ask the City Commission to reclaim The Guthrie (Application No. 23354)from administrative-only review and to place the review of The Guthrie before the
Community Development Citizen Advisory Board and City Commission for formal, full-and-fair, public hearings. In addition to my written public comment submitted Mar 26, 2024
(Footnote 1), my reasons for making this request are as follows:
(1) Process and trust: Administrative-only reviews of proposed development projects
occur behind the closed doors of the Community Development Department. Consequently,
such reviews minimize public participation in the review process and lack public
transparency. Minimization of public participation in the review process and lack of public
transparency contribute to the ongoing lack of trust between Bozeman residents and the
Community Development Department and between Bozeman residents and the City
Commission.
One way for the City Commission to begin rebuilding trust with Bozeman residents is for the
City Commision to reclaim the review of The Guthrie (Application No. 23354) from the
Community Development Department (BMC Sec. 38.200.010.A - Review Authority,
Footnote 2) and then to place the review of The Guthrie in front of the Community
Development Citizen Advisory Board and the City Commission for formal, full-and-fair,
public hearings. Doing this will begin to rebuild trust between Bozeman residents and the
City Commission.
(2) De facto Type 3 short-term rentals: Arguably, The Guthrie's offering of some of its111 units as 30-day rentals will allow such units to be de facto Type 3 Short-term rentals
in violation of the purpose, spirit, and intent of BMC Sec. 38.360.260.A - Short term
rentals (Footnote 3).

review and require revisions to all development proposals subject to this chapter, and delegates that
authority in certain circumstances as set forth below. The purpose of this review is to prevent

provide for its mitigation; to protect public investments in roads, drainage facilities, sewage facilities, water
facilities, and other facilities; to conserve the value of adjoining buildings and/or property; to protect the
