This letter is submitted in response to the 2nd Site Plan Submittal Community Development and
Engineering Comments, for Smart Foods Bozeman, 1601 West Main Street, Bozeman MT given October
14, 2021. The comments have been individually addressed as follows (please refer to the plans
resubmitted with this response letter):
Planning Comments
Comment: 1. Site Plan Submittal requirements. In order to be deemed a complete application, all the
information identified in this section of the BMC and the Site Plan Checklist must be provided with the
resubmittal. Specifically, the naming protocol for each of the plan sheets must be followed. We attached
an example of the proper naming for each sheet. Please rename the revised sheets to follow this naming
protocol.
Response: The site plan meets all requirements listed on the Site Plan Checklist and follows the protocol
of the BMC. Each Sheet has been changed to match and follow the proper naming protocol.
Comment: 2. Please provide an executed joint us parking agreement with the owner of the shopping
center. I attached an agreement template approved by our City Attorney for your use.
Response: City waived the requirements for the off-site parking agreement per email from Suzanna
Montana on November 19, 2021. “As long as you change the lot lines to include the parking required or
used by the grocery store, you do not need an off-site parking agreement.”
Engineering Comments
Comment: The engineering division met on 9-24-21 to form the basis of the department’s interpretation
of the recently updated completion of improvements code. Based on the interpretations decided in the
meeting the following criteria are no longer needed to complete the necessary improvements proposed
for the subject site. (BMC38.270. 030.D Concurrent Construction) 1-5: No Longer Needed.
Response: Noted.
Comment: The only Submittals that will be necessary before building permit approval are approval from
fire and Fire Line infrastructure submittals. Approval from fire was submitted and filed on 10-6-21.
Please submit fire line infrastructure plans for approval. (The applicant must prepare plans and
specifications for any fire service line in accordance with the City’s Fire Service Line Policy. The plans
must be prepared by a Professional Engineer and be provided to and approved by the City Engineer
prior to initiation of construction of the fire service or fire protection system. The applicant must also
provide Professional Engineering Services for construction inspection, post-construction certification
and preparation of mylar record drawings. Fire service plans, and domestic services 4” or larger, must be
a standalone submittal, separate from the site plan submittal. City of Bozeman applications for service
must be completed by the applicant. The applicant must submit a fire line service for review.)
Response: We have received Fire approval which will be included in this submittal.
Comment: The applicant provided a CCR that is out of date and not directly applicable to the subject site
development. The applicant must provide the above noted easements (mutual access easement and
drainage easement) or submit an updated CCR agreement.
Response: The easement documents will replace the CCR’s. As per conference call on October 20, 2021,
the easement documents have been created in anticipation of signing after the new buying entity
(MBHT Bozeman, LLC) purchase the property following the recording of the boundary line adjustment
plat.
Comment: It appears that the trash enclosure is encroaching upon the existing sewer easement. The
applicant must show the existing easement on the site plan and ensure the enclosure is not encroaching
on the easement.
Response: The trash enclosure has been moved out of the easement.
Comment: Water rights and/or payment of cash-in-lieu of water right is required prior to development
for the demand on the City’s potable water system. The applicant must contact Griffin Nielsen with the
City Engineering Department to obtain a determination of cash-in-lieu of water rights (CILWR)
Acknowledged, submittal pending.
Response: Acknowledged
Comment: Water Design Report- a. DSSP Section V A.6.e. A meter pit is being proposed – please reach
out to John Alston the city utilities manager for conformation that this meter pit may be used.
Response: In speaking with John Alston, we could not find a meter pit being proposed in the plans or in
the water design report, he has approved our plans.
Comment: b. DSSP Section V D 1. The gas line is within less than 10ft of the sanitary sewer, water, and
storm sewer service lines. There must be 10ft separation between these service lines and the gas lines.
Response: The Utility lines have been re-arranged to meet the requirements. Please see Utility Plan.
Comment: DSSP Section V (B) (11) – The applicant has proposed a 6” sanitary sewer main connection to
a 4” sanitary sewer service. The connection to the main must be referenced on the drawings and
specifications with the same diameter as the service that will be connecting to it. All sewer services are
to be installed perpendicular to the main.
Response: All sewer lines have been changed to have the same diameter and all services have been
installed perpendicular to the main sewer service, please see C3.1 for reference.
Comment: The applicant must contact the City’s solvent site consultant, Jim Sullivan, the Principal
Engineer at Tasman Geosciences, Inc. out of Billings Montana and work with him and the DEQ project
manager Katie Frye to build the project according to any site specific solvent site conditions. The
applicant must acknowledge and make applicable to the subject site plan the following attached
documents: i. Lot 2- Declaration of Covenants (002), ii. BSS Institutional Controls Requirements, iii.
(MDEQ) Smith_Lot2_20201124_letter
Response: A copy of the site plan has been sent to Katie at the DEQ for review and approval. These
documents have been acknowledged on C1.1 under the site data table, and have been made applicable
to the site plan.
Comment: See attached SID waiver to be signed and notarized by the applicant. Provide a copy of the
recorded SID waiver PRIOR to Site Plan approval.
Response: As noted in our meeting on October 20, 2021 these do not need to be notarized as of yet.
