I spoke with Griffin Nielson this morning and he was indicating that the sewer flows that we provided did not trigger the need for a new sewer line. He wanted us to document the sewer flows and also make sure that the Cafe Rio water bill was from a very similar size as the new Cafe Rio in the shopping center. The City is quite difficult to deal with and it is difficult to get direct answers. What we have however found that Griffin Nielson to be one of the more reasonable people at the city. He will be dealing with the sewer capacity and the traffic study. The following issues have been researched during our preliminary due diligence: 1. sewer flows for Homegoods and Cafe Rio will not trigger construction of the offsite sewer. 2. a traffic study needs to be completed to determined if offsite mitigation is required with the proposed new building. The city has a level of service "C"That has to be achieved or mitigation may be required. Our research indicates that the city is requiring upgrades to intersections where needed but only within the existing right of way. Many of the adjacent intersections in question are mostly fully improved within the existing right of way. Thus the city would not normally require any improvements even if the level of service is exceeded. We would recommend doing the traffic study as our next step. 3. Impact fees for the two proposed new uses will total $55,647 for Cafe Rio and $252,888 for Homegoods. 4. the driveway on 15 North ave. will need to be relocated to 150'from the roundabout for a right in/right out or 330' for a full access driveway. 5. storm water regulations will need to be planned for including a new detention basin at the northeast corner of the property. 6. the ditch is not to be used for any storm water conveyance system. The ditch easement requirement is not know at this time, however it should not have an impact on development. 7. the special improvement district projects that they are asking you to waive your objection to the formation of the district, this is an old antiquated funding for city improvements. The city is not using them very often and is mostly doing projects through general fund monies. This does not preclude the opportunity to protest the participation percentage that they would like you to participate if one is formed. They are used most often now for street light projects. If one is setup the city normally participates in the funding otherwise the residents will come out of the woodwork in protest of the project. 8. Roundabout is not currently moving to construction. The roundabout layout is attached for reference. 9. the water rights in lieu of cash fees are estimated to be $13,774 for the Homegoods retail store. Please review and let's plan a time to discuss. (see email below) We had provided some water consumption numbers from other existing facilities to run the model. At that time, you indicated that the existing offsite sewer in question had capacity to handle the new growth without constructing a new sewer line. The shopping center has some new uses including a 20,000 sf retail store. These uses will not exceed the consumption numbers we previously used. Would you be able to confirm that the existing sewer main is still has the same remaining capacity, or if the system has had new facilities that have maxed out the sewer line?
