Exclusive Use Downtown Sidewalk Encroachment Permit
Narrative
The existing front entrance ramp and stairs encroach into the Main Street ROW leaving a
pedestrian clear aisle of approximately 13.00’.
The proposed entrance reconfigures the ramp alignment and stair location to provide better
code compliant access to the front door of the building.
As shown in Exhibit A, the proposed encroachment would yield a pedestrian clear aisle ranging
between 12.96’ and 8.82’.
Below are the specific dimensions of the proposed pedestrian clear aisle.
The proposed clear aisle widths adjacent to the planter boxes essentially maintain the existing
13.00’ dimension.
The stairs and street tree significantly reduce the existing 13.00’ pedestrian clear aisle down to
10.61’ and 8.82’ respectively.
Justification of the clear aisle at the stairs
The difference between the finished floor elevation of the building is 4813’ and the sidewalk
elevation is 4909’. Applying the minimum IBC stair tread width and height standards requires 7
risers.
The top landing is the minimum allowed of 4.79’ due to the 18” minimum ADA clearance
beyond the swing of the front door.

The terminus of the stairs is dictated by meeting these minimum IBC and ADA dimensional
standards.
Justification of the clear aisle at the street tree
The Bozeman UDC requires street trees for all downtown streetscapes. The proposed
location of the street tree well is the only possible location that does not conflict with the
existing egresses, existing private underground utilities, and the proposed public utilities. The
location of the street tree creates the narrowest pedestrian clear aisle at 8.82’. The only way to
eliminate this constriction would be to waive the street tree requirement.
