HomeMy WebLinkAbout48_Subdivision Variance Requests 2304 N. 7TH AVENUE | SUITE L | BOZEMAN, MT 59715 | (406) 587-2781 Professional Consulting Engineers and Land Surveyors Equal Opportunity Employer | www.hyaliteeng.com November 20, 2023 City of Bozeman- Community Development Department PO Box 1230 Bozeman, MT 59771 Attn: Danielle Garber - Associate Planner, Community Development Cody Flammond, PE- Development Review Engineer RE: Urban + Farm Phase 2 Major Subdivision- Preliminary Plat Submittal Subdivision Variance Request Bozeman, Montana Dear Danielle & Cody: On behalf of Outlaw Partners & Laurel Parkway LLC, the purpose of this letter is to request a subdivision variance from the requirements of BMC 38.400.010 & 38.220.040.B- “When a proposed development adjoins undeveloped land, and access to the undeveloped land would reasonably pass through the new development, streets and alleys within the proposed development must be arranged to allow the suitable development of the adjoining undeveloped land.” In regards to the BMC for the request & granting of the variance, relief from the standards relating to the improvements within public rights-of-way when such standards would result in undue hardship and are not essential to the public health, safety and general welfare. In this application there are 3 total locations that are being requested in terms of this standard and they are: 1- the East end of Valley Commons where the roadway would approach the existing wetlands; 2- the West end of Valley Commons where the roadway would approach the existing conservation easement; & 3- the West end of Competition Drive where the roadway would approach the existing conservation easement. For the eastern instance where the Valley Commons roadway would encroach upon the existing wetlands, it is both a hardship and a hinderance to impact the existing wetlands in such a way to only provide a partial connection as the parcel to the East is already developed. In regards to the Western connection points for both Valley Commons & Competition Drive, the parcel directly west of the subdivision is under an existing conservation easement that cannot be developed at this point in time, therefore the physical road connection poses a hardship and acts against the betterment of the general public by cutting up the proposed trail & park space. Our formal request at this time then is to not provide right-of-way to the eastern boundary as that land is already developed, as well as to then not construct that same physical connection point. On the west side of the project, it is proposed to still provide the platted right-of-way to be able to access that western boundary in the future, however it is requested to not construct the physical roadway at this time due to the constraints as posed above.
