To the City Commission & Community Development Department Having lived in Bozeman since 1971, and built a custom home in Sundance Springs in 2005, Ihave very strong feelings about the proposed commercial development to be located on Sundance Springs Neighborhood Services Lot 2. Listed below are several items that areagainst existing development guidelines and codes.......all of which would stop this proposed project from being built, or the plans seeing the light of day......period. 1.) The City has indicated they "lost" the Approved Sundance Springs Planned UnitDevelopment Master Plan. Without the final Master Plan, this project cannot proceed legally. Despite this fact, the City has allowed the building process to move forward, andapproved this illegal site plan. 2.) This illegal site plan and project violates many of the mandatory PUD development guidelines, such as: Only one, one-story 5,000 sq. ft.building is allowed......not 2, two-story buildings withmore than 6,000 sq. ft. Flat roofs and glass exteriors are not allowed......this project both. All outdoor activities, including fire pits, large patios and seating for 250 people are notallowed......all this with only 43 parking spaces. What I cannot believe is the City approved three exemptions to the building code......the exemptions MUST enhance the site plan: 1.) The building placement violates many codes such as block frontage standards, setbacks,open space requirements and the lack of permission to access trails NOT owned by the developer.2.) Parking is only allowed, BY CODE, to the side, or above/below the building......this project grossly violates this code. This project has not met the Document Burden to move forward with the failure to produce theFinal Master Plan......thereby cannot receive proper review of comparison to the original Final Master Plan. There are so many things wrong with this proposed development......least ofwhich, this development will result in permanent damage and pose irreparable harm to the homeowners of Sundance Springs and surrounding neighborhoods. To put the overall perspective mildly, the inappropriate, and overzealous developmentoccurring in Bozeman is an open display of greed and collusion between developers, Community Development Department and City Commission. The Community DevelopmentDepartment and City Commission are complicit in the deliberate destruction of the character of Bozeman. Approval of this project is yet another display of NOT complying with YOURlegal requirements for developments.......and NOT LISTENING TO THE PUBLIC!!!!!
