RE: Appeal of Site Plan #22047 Dear Mayor Cunningham and Commissioners, This isn’t a difficult decision. The Applicant’s proposal should never have gotten this far. You have a chance to rectify this quickly and efficiently by following mandated regulations, to which the City is a Party. If you have not had a chance to read the numerous submitted comments by owners in the subdivision and attorneys some of us have hired, you can read the Findings of Fact and Order (Condition #29) - Sundance Springs PUD, the Master Plan, and the Subdivision Covenants to know that this proposal should never have gotten off the starting block. The proposed development is not at all in keeping with the regulations for the property in question. It is not a matter of redesigning or adding a couple more parking spaces. The proposal needs to be tossed. Others have explained in detail the reasons for that being your only choice. In 2000 when we bought our lot and built our home in Sundance Springs, we felt assured we could live out our days in this home and neighborhood due to the clear regulations in place in the PUD, Master Plan, and Covenants. We understood and agreed to the possibility of commercial development at the southwest end of the subdivision as it was clearly and legally defined what would be allowed in the above mentioned documents. This Application violates the PUD, Master Plan, and Covenants in numerous ways about which you are fully aware. The fact that the city planner (past and current) and the city legal staff have let this Application proceed this far is not only poor and unethical practice, but an embarrassment to those of you who have to clean up the mess. But clean it up, you must, by granting the appeal and rejecting the application completely. Do the right thing.
