The solvent site was cited by the City in site plan review comments, and they indicated that no new wells could be
drilled within the solvent site boundary. I did not check the boundary so thank you for looking at that for me. It appears
the exisƟng well falls outside of the solvent site so their comment should not have any bearing on the exisƟng well.
I have seen this before on previous projects for dewatering applicaƟons. When a porƟon of the project falls within the
BSS boundary the City opts on the side of cauƟon, but aŌer working with DEQ they idenƟfied the boundary and did not
require any restricƟons on our permit. I believe we are in a similar situaƟon with the use of this well.

Alex –
Are you confident that the well is in the Bozeman Solvent Site (BSS)? According to the GWIC, the well is located just
outside the BSS. See the map at the boƩom of this email (well is a small red cross, BSS boundary is a translucent orange,
and the property is a translucent green). Generally, if an irrigaƟon water right predates the BSS it is OK to conƟnue to
use it for irrigaƟon. In this case the water right was issued aŌer the BSS was created. This may be explained by the fact
that the well is not in the BSS. I did not see any menƟon of the BSS in the water rights file.

Bozeman solvent site but appears to have an acƟve water right for irrigaƟon. Please let us know if we can use the on-site

Hi Alex,
So I haven’t been able to dig up any documentaƟon on historic CILWR analysis or agreements. The preliminary CILWR
fee is $2,913. Before we finalize the fee we’ll need confirmaƟon from the DNRC authorizing use of the exisƟng well
otherwise we’ll need to roll the irrigaƟon demand into the fee.

At a quick glance, I didn’t see the original PUD reports but that’s not to say they aren’t in there. We’ve been trying to
digiƟze old hard copy reports but the process is been slow. You might check in with the development review engineer
assigned to the project to see if they have beƩer luck.

Hi Griffin,
Please let me know if you are able to gain any ground with planning on this project. AddiƟonally, we will be projecƟng
demands for the office building and would like to reference the original design report used for the PUD submiƩal, but
we are having a hard Ɵme tracking that down. Do you happen to have the original design report for water/sewer/storm
on file?

Hi Brian,
I am hoping you can assist us with a Cash in lieu of water rights determination. The project is a site plan that falls within
the greater 1001 W Oak Site Plan (COB #22182). I have attached two plan sheets. The first is the approved W Oak Site plan
and the second is the building that is being proposed for the Braxton Office building in the SW corner of the
development. The proposed building has a footprint of 8,060 and 7,758 SF for the first and second levels respectively for
a total of 15,818 SF. The full footprint is proposed for office space.
We are requesting a determination of CILWR for domestic demands. There is a well on site that will be used for Irrigation. I
would also like to know if you can provide the status of the existing water rights tied to the property and any agreements
that were made for the overall site plan that may impact our use.
Please let me know if you require any additional information to make this determination.
