CALL FOR BIDS
NOTICE IS HEREBY GIVEN that the City of Bozeman, Montana, is accepting sealed bids for:
5th & Main Residences – Offsite Infrastructure
Separate sealed bids for Construction of the 5th & Main Residences – Offsite Infrastructure project will
be received by the City Clerk at the office of City Hall, 121 North Rouse Ave., Suite 200, P.O. Box 1230,
Bozeman, Montana 59771-1230 until 2:00 p.m., local time, on Wednesday, March 1st, 2024, and then
publicly opened and read aloud.
Please write the name of the project on the front of the sealed bid.

Bids must be received before 2:00 p.m., local time, March 1, 2024. Original copies must be
submitted - no faxed or electronic bids will be accepted. Bids will be opened and read following
the close of bids.
The project work is generally described as follows:
Construction of offsite infrastructure associated with the 5th & Main Residences project and related
improvements:
• Installation of a replacement sewer main in W Mendenhall Street
• Installation of a new sewer main in N. 5th Avenue
• Replacement of live sewer services to back-of-curb
• 2” asphalt mill and overlay – W. Mendenhall Street
• 2” asphalt mill and overlay – 1/2 block of N. 5th Avenue
• Street reconstruction – 1/2 block of N. 5th Avenue
Bidding Documents will be available from ARCO/Murray in electronic PDF format. For access to
electronic documents, bidders should contact Andrew Glover (aglover@arcomurray.com) of
ARCO/Murray.
There will be a Pre-Bid Conference at the construction job trailer for the 5th & Main Residences
Project located between 408 and 416 W. Mendenhall Street at 10:00 AM on February 21, 2024.
Interested CONTRACTORS are encouraged to attend. Questions and other inquiries concerning this
project should be directed to Andrew Glover of ARCO/Murray at 612-222-7325.
CONTRACTOR and any of the CONTRACTOR’S subcontractors bidding or doing work on this project
will be required to be registered with the Montana Department of Labor and Industry (DLI). Forms
for registration are available from the DLI, PO Box 8011, 1805 Prospect, Helena, Montana 59604-
8011. Information on registration can be obtained by calling (406) 444-7734. CONTRACTOR is not
required to have registered with the DLI prior to bidding on this project, but must have registered
prior to execution of the Construction Agreement. All laborers and mechanics employed by
CONTRACTOR or subcontractors in performance of the construction work shall be paid wages at
rates as may be required by the laws of Gallatin County and the state of Montana. Discrimination
in the performance of any agreement awarded under this project on the basis of race, color,
religion, creed, sex, age, marital status, national origin, or actual or perceived sexual orientation,
gender identity or disability is prohibited. This prohibition shall apply to the hiring and treatment
of the awarded entity’s employees and to all subcontracts. Every entity submitting under this
invitation must sign and return the required affirmation.
As such, each entity submitting under this notice shall include a provision wherein the submitting
entity, or entities, affirms in writing it will not discriminate on the basis of race, color, religion,
creed, sex, age, marital status, national origin, or because of actual or perceived sexual orientation,
gender identity or disability and which also recognizes the eventual contract will contain a provision
prohibiting discrimination as described above and that this prohibition on discrimination shall apply
to the hiring and treatment of the submitting entity’s employees and to all subcontracts.
In addition, pursuant to City Commission Resolution 5169, the entity awarded a contract under this
RFQ and any subcontractors must abide by the Equal Pay Act of 1963 and Section 39-3-104, MCA
(the Montana Equal Pay Act), and affirm it will abide by the above and that it has visited the State
of Montana Equal Pay for Equal Work “best practices” website, or equivalent “best practices
publication and has read the material.
Each Bid or proposal must be accompanied by a Certified Check, Cashier’s Check, or Bid Bond
payable to the City of Bozeman, Montana, in an amount not less than ten percent (10%) of the total
amount of the Bid. Successful BIDDERS shall furnish an approved Performance Bond and a Labor
and Materials Payment Bond, each in the amount of one hundred percent (100%) of the contract
amount. Insurance as required shall be provided by the successful BIDDER(s) and a certificate(s) of
that insurance shall be provided.
No Bid may be withdrawn after the scheduled time for the public opening of bids, which is at 2:00
p.m., local time, March 1, 2024.
The right is reserved to reject any or all proposals received, to waive informalities, to postpone the
award of the contract for a period of not to exceed sixty (60) days, and to accept the lowest
responsive and responsible bid which is in the best interest of the OWNER.
