______________________, GRANTOR, in consideration of $ 1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman,
Montana 59715, GRANTEE, its successors and assigns, a perpetual utility easement for the use
of each and every person, firm or corporation construction, whether public or private, providing
or offering to provide telephone, electric power, gas, internet, cable television or other similar
utility or service, the right to the joint use of an easement for the, maintenance, repair, and
removal of their lines and other facilities, in, through, and across a strip of land situated in
Gallatin County, Montana, , feet wide to be located on the following described real
property:
The easement is more particularly described on the attached Exhibit(s) _______ which by
this reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.

UTILITY EASEMENT - DESCRIPTION
A utility easement located on a portion of Lots 40, 41, 42, 43, 44, 45, and
46, Block "E", Tracy's First Addition to Bozeman, Montana, on file in the
Office of the Gallatin County Clerk and Recorder, located in the
northeast quarter of Section 12, Township 2 South, Range 5 East,
Principal Meridian Montana, County of Gallatin, State of Montana, being
more particularly described as follows:
Beginning at the southwest corner of Lot 40, said point also being on
the easterly right-of-way line of an alley, thence N0˚09'39”W, 10.00 feet
along said right-of-way line and the westerly line of said Lot 40; thence
N89˚53'47”E, 196.39 feet to the easterly line of Lot 46; thence
S0˚13'12”E, 10.00 feet along the westerly right-of-way line of an alley and
the easterly line of said Lot 46 to the southeast corner of said Lot 46;
thence S89˚53'47”W, 196.40 feet along the southerly line of Lots 46, 45,
44, 43, 42, 41, and 40 to the Point of Beginning. Containing 1,964
