COMMISSION RESOLUTION NO. 2975
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, DECLARING THE CITY COMMISSION'S INTENT TO ESTABLISH A
1994 SIDEWALK PROGRAM AND TO ORDER THAT SIDEWALKS BE
INSTALLED IN CERTAIN AREAS OF BOZEMAN, AS PROVIDED FOR IN
SECTIONS 7-14-4109 AND 7-14A110, MONTANA CODE ANNOTATED.
WHEREAS, Section 7-14-4109, Montana Code Annotated, provides that a local
governing body may order sidewalks constructed in front of any lot or parcel of land; and
WHEREAS, the City Commission has established a five-year program for installation
of sidewalks along streets throughout the entire community; and
WHEREAS, the City Commission has determined that the installation of sidewalks
along the below-listed streets is of high priority; and
WHEREAS, the City Commission did, on the 28th day of March 1994 adopt
Commission Resolution No. 2965, revising the City's sidewalk policy.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That, in accordance with the provisions of Section 7-14-4109, Montana Code
Annotated and the City's sidewalk policy, as established in Commission Resolution No.
2965, the City Commission declares its intent to order the installation of sidewalks along the
indicated sides of the following streets:
1. The north side of Kagy Boulevard between South 11 th Avenue and South
3rd adjacent to Montana State University, and lots 5 and 6 of Greek Way
Subdivision;
2. The south side of Durston Road between N. 22nd and N. 23rd, adjacent
to Lot 16, Block 4, West Park Manor No.3;
3. The west side of Willson Avenue, adjacent to Lot 13, Block 1,
Thompson's 2nd Addition; and
4. The north side of West Beall Street, adjacent to Lot 1, Block 4, West
Park Manor No.3.
Section 2
That at a regular session of the City Commission of the City of Bozeman, to be held
in the Commission Room, Municipal Building, 411 East Main Street, Bozeman, Montana, on
Monday, the 6th day of June 1994, at the hour of 7:00 p.m. of said day, is the time and

place when and where the City Commission will hear testimony in support of and in
opposition to the ordering of sidewalks as contained in Section 1, above.
The Clerk of the City Commission is hereby directed to publish notice of the adoption
of this resolution of intention.
PASSED AND ADOPTED by the City Commission of the City of Bozeman at a regular
session thereof held on the 23rd day of May 1994.

NOTICE IS HEREBY GIVEN that on the 23rd day of May 1994, at a regular meeting
of the City Commission of the City of Bozeman, Montana, said Commission duly and
regularly passed and adopted Commission Resolution No. 2975, entitled:

MONTANA, DECLARING THE CITY COMMISSION'S INTENT TO ESTABLISH A
1994 SIDEWALK PROGRAM AND TO ORDER THAT SIDEWALKS
BE
INSTALLED IN CERTAIN AREAS OF BOZEMAN, AS PROVIDED FOR IN
SECTIONS 7-14-4109 AND 7-14-4110, MONTANA CODE ANNOTATED.
A copy of said Commission Resolution No. 2975 is on file in the office of the Clerk
of the City Commission at 411 East Main Street, Bozeman, Montana, which states the City
Commission's intent to install sidewalks along particular streets within the city limits of the
City of Bozeman, as follows:
1. The north side of Kagy Boulevard between South 11 th Avenue and South
3rd adjacent to Montana State University, and lots 5 and 6 of Greek Way
Subdivision;
2. The south side of Durston Road between N. 22nd and N. 23rd, adjacent
to Lot 16, Block 4, West Park Manor No.3;
3. The west side of Willson Avenue, adjacent to Lot 13, Block 1,
Thompson's 2nd Addition; and
4. The north side of West Beall Street, adjacent to Lot 1, Block 4, West
Park Manor No.3.
NOTICE IS HEREBY FURTHER GIVEN that Monday, the 6th day of June 1994, at 7:00
p.m. at the Commission Room, Municipal Building, 411 East Main Street, Bozeman,
Montana, is designated as the time and place set for hearing and passing on all public
testimony in support of and in opposition to this proposed 1994 Sidewalk Program.
