HomeMy WebLinkAbout22378 Approval LetterPage 1 of 2 October 31, 2023 – Transmitted via Project Dox Will Ralph, BZN Hotel 2 LLC RE: 22378; TownePlace Hotel Site Plan for Lot 1A of Amended Eastlake Professional Center Subdivision Conditional Approval. Dear Mr. Ralph: The above-referenced Site Plan, application 22378, has received conditional approval. The condition of approval for this site plan is as follows: “The Applicant is advised that unmet code provisions or code provisions that are not specifically listed as conditions of approval does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code (BMC) or State law.” This is a standard condition for site plans. In addition, as noted in the staff report, staff advises you that the application must meet the following BMC code provisions: 1. BMC 38.360.060. Should the hotel propose a bar/lounge to sell alcohol for on-premise consumption, the owner shall submit a separate application for a Special Use Permit to the Director of Community Development for consideration for approval. 2. BMC 38.410.130. Water Adequacy: A preliminary cash-in-lieu of water rights determination has been performed for the project. Including amenities (bar, gym, indoor pool, etc. ) the 107-room hotel's estimated annual municipal water demand is 7.19 acre-feet. Before the fee determination can be finalized the applicant must provide a pre-determination from the DNRC demonstrating that the proposed irrigation well is allowed and providing the annual irrigation demand on the landscaping irrigation sheets. Prior to final site plan approval, all required cash-in-lieu of water rights (CILWR) must be paid. As you are aware, you must comply with all provisions of Chapter 38 of the Bozeman Municipal Code that are applicable to this project, including but not limited to the following: Code Provisions ▪ Per Section 38.100.080 & 38.200.110, the proposed project shall be completed as approved and described in this application. Any modifications to the submitted and approved application materials shall invalidate the project's legitimacy, unless the Applicant submits the proposed modifications for review and approval by the Department of Community Development prior to undertaking said modifications. The only exception to this law is repair. Page 2 of 2 Future Impact Fees - Building permit applications require payment of transportation, water, sewer and fire impact fees according to the City of Bozeman adopted impact fee schedule in place at the time of building permit issuance. In addition, other fees such as Cash-in-lieu of Water Rights (CILW) or infrastructure payback district fees may be required prior to issuance of a Certificate of Occupancy for any building within the MSP.
