COMMISSION RESOLUTION NO. 2976
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIT
CLAIM DEED TRANSFERRING LOT 5, BLOCK 1, TANGE'S ADDITION
FROM THE CITY OF BOZEMAN TO NORMAN S. HANDLER.
WHEREAS, the City Commission of the City of Bozeman did, on the 24th day of
May 1982, authorize the Mayor to sign a land exchange agreement which included the
transfer of land described below; and
WHEREAS, this transfer is essential for the Montana Department of Transportation
to acquire the necessary right-of-way for the installation of West Oak Street improvements
west of the west right-of-way line of North 7th Avenue; and
WHEREAS, the execution of a Quit Claim Deed is the final step in this transfer of
land between Norman S. Handler and the City of Bozeman; and
WHEREAS, the City Commission, pursuant to Section 7-3-4368, M.C.A., can
designate the City Manager to execute conveyances of real property.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana:
Section 1
That the City Manager is hereby authorized to execute the Quit Claim Deed for the
transfer of Lot 5, Block 1, Tange's Addition to Norman S. Handler.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana,
at a regular session thereof held on the 23rd day of May 1994.

QUIT CLAIM DEED
KNOW ALL MEN BY THESE PRESENTS:
THIS INDENTURE, Made the ..<3t1.d. day of ~ 1994, between
CITY OF BOZEMAN, a political subdivision of the State of Montana, with mailing address
of P.O. Box 640, Bozeman, Montana 59771-0640, Party of the First Part and NORMAN
S. HANDLER, with mailing address of 1625 Broadway, 8th Floor, Denver, Colorado
80202, the Party of the Second Part, WITNESSETH: That the said Party of the First Part
for and in consideration of the sum of One Dollar ($1.00) to it in hand paid by the said
Party of the Second Part, receipt of which is hereby acknowledged; does hereby convey,
remise, release and forever quitclaim unto the said Party of the Second Part, and to his
heirs, and assigns, all right, title and interest in and to the following described real estate,
situated in the County of Gallatin, State of Montana, to-wit:
Block 1, Lot 5 of Tange's Addition to the City of Bozeman as depicted on
Certificate of Survey No. H48~A and by Tract A-1 of the Certificate of
Survey No. H488, both of which are on file and of record in the office of the
County Clerk and Recorder of Gallatin County, Montana.
together with all the tenements, hereditaments, and appurtenances thereto belonging, and
the reversion and reversions, remainder and remainders, rents, issues and profits thereof;
and also all the estate, right, title, interest, property, possession, claim and demand
whatsoever as well in law as in equity, of the said Party of the First Part, of, in or to the
said premises and every part and parcel thereof.
TO HAVE AND TO HOLD, all and singular the said premises, with the
appurtenances unto the said Party of the Second Part, his heirs and assigns forever.
IN WITNESS WHEREOF, the said Party of the First Part has hereunto set its hand
and seal the day and year first above written.
