November 14, 2023 Dear Mayor Andrus and Bozeman City Commissioners, On behalf of Expedia Group, I am writing to share comments on the amended version of Ordinance 2149, revising Bozeman’s short-term rental code. While we applaud the amendment to allow existing, permitted Type 3 rentals to continue operations, there are some inconsistencies in the ordinance. We recommend changing the definition of “host” in Section 38.360.260(C)(2) to “a natural person who has the legal right to offer the dwelling unit for use as a short-term rental”. The current definition of host, “a natural person who occupies a dwelling unit as the person’s primary residence” is inconsistent with Legacy Type 3 rentals since Type 3 rentals are, by definition, not primary residences. The rest of the statute clarifies that Type 1 and Type 2 short-term rentals must be primary residences, so defining a host as a primary resident is redundant. We also recommend amending the beginning of Section 38.360.260(I) to include “Legacy Type 3”, so it reads “Short term rental standards. The following requirements apply only to Type-2 and Legacy Type 3 short-term rentals unless otherwise noted” to clarify that Legacy Type 3 rentals are still responsible for complying with these requirements.
