A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF
BOZEMAN TO CREATE AN EXTENDED SPECIAL IMPROVEMENT DISTRICT
NO. 663 FOR STREET IMPROVEMENTS FOR THE ENGINEERING DESIGN,
CONSTRUCTION, INSPECTION AND ENGINEERING CERTIFICA TION
OF
ASPHAL T CEMENT PAVING, GRAVEL BASE COURSES AND SUBGRADE
PREPARATION, CURB, GUTTER AND SIDEWALKS, STORM DRAINAGE AND
ALL NECESSARY APPURTENANCES TO CONSTRUCT A 1,642-FOOT
PORTION OF WEST OAK STREET, FROM THE WEST EDGE OF NORTH 19TH
AVENUE WEST, IN THE CITY OF BOZEMAN, MONTANA.
WHEREAS, the City Commission has received a written petition from property owners
abutting the proposed street requesting the creation of a special improvement district for
purposes of paving West Oak Street, storm drainage, and the installation of water improvements,
from the west edge of North 19th Avenue west a distance of 1,642 feet; and
WHEREAS, receipt of the aforesaid petition was acknowledged by the City Commission
during its meeting of May 31, 1994; and
WHEREAS, the Bozeman City Commission has determined, and hereby declares, that
the public interest and convenience requires the creation of the special improvement district as
hereinafter described for the construction of street improvements hereinafter described; and
WHEREAS, the improvements are of more than local or ordinary benefit, which requires
that said district be an extended district; and
WHEREAS, the properties within this district are especially benefited by construction
of these improvements, and these properties shall be assessed to pay the costs and expenses
thereof.
WHEREAS, properties requesting creation of this Special Improvement District comprise
approximately 66 percent of the properties located within the boundaries of the proposed
district.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create an
extended special improvement district known and designated as "Special Improvement District
"--.- _..
No. 663" of the City of Bozeman, for the construction and paving of Oak Street, along with
storm drainage, from the west edge of North 19th Avenue west a distance of 1,642 feet, as set
forth in the attached Exhibits "A" and "B".
Section 2
Boundaries
The boundaries for Special Improvement District No. 663 are described as follows, and
as shown on the map attached hereto as Exhibit "A":
A tract of land being all of Brentwood Subdivision (replatted), Tract C of
Certificate of Survey No. 1240E, Tract 2 and a portion of Tract 1 of Certificate
of Survey No. 1240H, a portion of Tract 2-A 1 of Certificate of Survey No.
1240G, a portion of Tract D of Certificate of Survey No. 1240F, and that
public park of Annie Subdivision Phase I, all situated in the SE ~ and NE ~ of
Section 2, T2S, R5E, Montana Principal Meridian, Gallatin County, Montana.
The boundary of Special Improvement District No. 663 is more particularly
described as follows:
Beginning at a point which bears S880 11 '40"W a distance of 85.00 feet from
the East one-quarter corner of said Section 2, and which point is also common
to Tract C of Certificate of Survey No. 1240E and the Westerly Right-of-Way
line of North 19th Street; thence along said Right-of-Way line S02004'00"E
a distance of 1542.37 feet; thence S87056'00"W a dista-nce of 302.29 feet;
thence along a curve to the left with a radius of 680.00 feet a distance of
501.29 feet to a point on the North Right-of-Way line of Annie Street; thence
along said Right-of-Way line along a curve to left with a radius of 1350.00 feet
a distance of 984.68 feet; thence NOo037'50"W a distance of 2447.04 feet;
thence N89032'44"E a distance of 1643.74 feet to a point on said Westerly
Right-of-Way line of North 19th Street; thence along said line 501031 '29"W
a distance of 1 014.78 feet to the point of beginning.
Said Tract being 97.333 acres or 4,239,854 square feet and is subject to all
easements of record.
Section 3
Character of Improvements
The character of the improvements to be made within this district are the engineering
design, construction, inspection and engineering certification of street improvements, including
subgrade preparation, gravel base courses, asphalt cement paving, curb, gutter, sidewalks, storm
drainage and all necessary appurtenances to construct a 1 ,642-foot portion of West Oak Street,
from the west edge of North 19th Avenue west.
Section 4
Estimate of Cost
The total estimated cost of the improvements, including construction costs, engineering,
contingency, Special Improvement District Revolving Fund, City administrative charges and
incidental expenses, is Two Hundred Thirty-Nine Thousand Six Hundred and Nol1 00 Dollars
($239,600.00).

Section 5
Finding of Benefit and Method of Assessment
The City Commission of the City of Bozeman hereby finds, determines and declares that
each of the lots, blocks, tracts, pieces and parcels of land, abutting and non-abutting, situated
within the boundaries of the district, will be especially benefited and affected by such
improvements and the property included within the district is hereby declared to be the property
to be assessed for the cost and expense of making said improvements.
The cost is to be assessed against the entire district. Each lot, block, tract or parcel of
land within the district will be assessed for that portion of the whole cost which its area bears
to the area of the entire district, exclusive of streets, avenues, alleys and public places.
The total actual assessable square footage within the entire district is 3,921,144 square
feet and is the area on which all protests will be received, considered and determined. It is also
the square footage on which all assessments will be figured.
Section 6
Payments
The payments for said improvements shall be made in twenty-eight (28) semi-annual
installments extended over a period of fourteen (14) years; however, this shall not be construed
to prevent payment in full at any regular payment date by any property owner who desires to
do so. It is proposed to pay the entire cost and expense of said improvements with cash to be
obtained from the sale of bonds of said extended Special Improvement District No. 663, as
authorized by law. Such bonds will be in denominations of Five Thousand Dollars ($5,000) each,
and fractions or multiples of $5,000 where necessary, to be issued and chargeable against a
fund known and designated as the extended Special Improvement District No. 663 Fund of the
City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples,
and in the order of their registration, from whatever funds are available for the purpose of said
extended Special Improvement District No. 663. Said bonds shall draw a simple interest from
the date of their registration until called for payment, which interest shall be chargeable as part
of the cost of said improvements. The bonds will be issued and sold in accordance with the
provisions of Section 7-12-4201 and Section 7-12-4223, M.C.A., and all other applicable
provisions of Title 7, M.C.A., relating to special improvement districts for cities and towns, and
any amendments thereof.

Section 7
Protests and Notices
That the regular session of the City Commission of the City of Bozeman, to be held in
the Commission Room, Municipal Building, 411 East Main Street, Bozeman, Montana, on
Monday, the 1 st day of August 1994, at the hour of 7:00 p.m. of said day, is the time and place
when and where the City Commission will hear and pass upon all written protests, if any, duly
and regularly made and filed with the Clerk of the Commission for the City of Bozeman not later
than 5:00 p.m. on Thursday, July 28, 1994, against the creation of said Special Improvement
District No. 663, the improvements proposed to be made pursuant thereto, and the extent and
character thereof, or either thereof. The Clerk of the City Commission is hereby directed to give
notice in the manner and for the time as by law required, of the adoption of this resolution of
intention.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at
a regular session thereof held on the 11 th day of July 1994.

the City Commission at 411 East Main Street, Bozeman, Montana, which sets forth the
description of the boundaries.
NOTICE IS HEREBY FURTHER GIVEN that Monday. the 1 st day of August 1994, at hour
of 7:00 p.m., at the Commission Room, Municipal Building, 411 East Main Street, Bozeman,
Montana, is the designated time and place set for hearing and passing on all written protests,
if any, duly and regularly made and filed with the Clerk of the Commission for the City of
Bozeman not later than 5:00 p.m. on Thursday, July 28, 1994, against the creation of said
