Upon a site visit, the Planning Director and Code Compliance Officer have made the following findings in regard to condition#2 (landscaped area): 1. The storm water detention area must be re-graded with sloping sides down to a -1 foot elevation below the concrete header, so that a 720 cubic foot capacity is achieved for storage as originally calculated, depicted and approved on Final Site Plan#Z-92117 for the retail facility. As currently constructed, there is no storage capacity; run-off is not detained as required. The new configuration is okay, with the grade changes as noted. The sloped sides and most of the pond bottom must be sodded. 2. The irrigation system recently removed must be replaced. 3. The sod installed is acceptable, but the groupings of juniper, ash, and aspen as originally depicted and approved on the Final Site Plan must be installed. Species may be substituted if depicted on a revised plan by a Montana nurseryman or qualified landscape designer. 4. Pin-down wheel stops are recommended immediately in front of the concrete header to protect the detention pond area. Rather than be installed prior to the issuance of a building permit, these improvements may be financially guaranteed, per the attached cost estimate, as long as they are installed within nine (9) planning zoning • subdivision review • annexation historic preservation • bowing •grant administration neighborhood coordination Simkins-Hallin#Z-92117A September 29, 1999 Page 2 of 2 months of the issuance of a building permit. Your letter of credit, or other acceptable form of financial guarantee, must be valid for one year. Your bank can contact me directly if there are questions regarding what would be acceptable as a financial guarantee. In regard to condition#2 (handicapped accessibility provisions), prior to the issuance of a building permit, the accessible spaces must be delineated with on-pavement striping and symbols. Orange spray paint is not acceptable. The spaces must be 13'wide each with a 5'ramp area striped between. In the alternative, one space can be 13'wide for van accessibility with a 5'ramp area striped between it and a 9'space, with adequate on-pavement symbols and signage. The striping must be 4" wide. This building is used by Simkins-Hallin Lumber Comany as a truss manufacturing facility. We have been notified by the city that an'impact fee"of approximately$5000 is assessed for this expansion. We understand we can apply for a one-time waiver of the "impact fee"related to the expansion. This letter serves as our application for the waiver. We protest the"impact fee"assessed for the expansion by the City for the following reasons,but we feel it is more expedient to simply apply for the waiver. ♦ First,we believe a comprehensive and accurate study to determine the"impact,"if any,of this expansion needs to be done in order for the City to comply with the constitutional requirements that the U.S. Supreme Court promulgated in the Dolan decision. ♦ Second,we challenge the legal basis for the fee,because we believe the City has no statutory authority under Montana law to enact such a fee. ♦ Third,we disagree with the City's interpretation of its ordinance that the one-time waiver applies to an entire prior planned Unit Development. The Planning Director has determined that the proposal could be reviewed as a modification to an approved Planned Unit Development as the addition is a relatively small element of the overall Simkins-Hallin complex. Having reviewed related zoning files and conducted an inspection of the Simkins-Hallin properties, I present the following findings and recommendations to you for your consideration. Your comments and recommended conditions are appreciated. Most of the buildings in the Simkins-Hallin complex, properties owned by Westland, Inc. and Simkins Properties, were constructed prior to 1990. More recent developments include the 8,568 square foot Truss Manufacturing Building (File #Z-9062 MiSP/COA) and the 13,728 square foot Simkins-Hallins Retail Store (File#Z-92117 PUD). The following issues should be addressed: A) Parking, Employee & Handicapped Accessible - A condition of FSP approval for the Truss Plant Minor Site Plan Application#Z-9062 was that a 13-space employee parking lot,just north of the 919 Fridley warehouse, must be paved within 4 years of 02/17/92. This exception to code requirements was permitted because the applicant planned.to submit a PUD application for the overall site and retail store. The following condition of approval was imposed during the review of the Retail Store/Overall Complex PUD (#Z- 92117): "That in the event the dust control/abatement program fails, and dust from the lot becomes a problem, the applicant be required to pave the truss plant employee parking lot as originally conditioned in the approval of the truss plant Conditional Use Permit [Minor Site Plan#Z-9062]." Neither an employee parking area as originally proposed on the east side of the Truss Plant (#Z-9062) nor the employee parking area proposed just north of the 919 Fridley warehouse exist. Both areas appear to be used as storage. It appears that both the Retail Store(#Z-92117) lot and Broadway are heavily used by employees. Property currently being utilized as the "designated" employee parking area is located at the northwest corner planning zoning • subdivision review • annexation • Historic preservation housing • grant administration 0 neighborhood coordination of Broadway&Avocado. This"designated"employee parking lot,which lies just north of the berm along the Avocado Street r-o-w, is gravel. According to the C&R records, Westland, Inc. owns only the southern tip of this parking area, and the remainder is owned by Charles Schlegel. The FSP approved for the Retail Store shows 31 regular and 2 handicapped spaces, and appears to attempt to address only the retail use (10272 S.F./300 =34 plus 2 HQ, not the employee parking needs of the plant. In addition, only one handicapped accessible space is provided on-site. The signage is located on the retaining wall at a height of less than 4 feet and does not contain the "Permit Required, $100 Fine" language. The employee parking area issues should be resolved. Whether employee parking facilities are paved or not, at minimum, the proper written agreements should be obtained from Mr. Schlegel. B) SID Waivers - The minor site plan review of the Truss Building (#Z-9062) required SID waivers for improvements to Front, Fridley and Broadway. Waivers for improvements to Front and the signalization of Peach/Rouse have been recorded under Film 127 Page 3119-3122. If improvements to Fridley and Broadway are still issues, those waivers should be obtained with this proposal. If the Broadway/Front truck route is still part of the transportation plan, there may be other considerations, including the existing building over the platted Front Street r-o-w and other transportation network improvements. C) Other Notes - The existing water service line appears to run under the proposed addition along the existing building's western elevation. Planning staff recommends the following conditions of approval of the proposed Modification to an Approved PUD: 1. Prior to the issuance of a building permit, the applicant must record with the County Clerk and Recorder's Office a parking easement granted by the owner of record for use of the "designated"employee parking area located at the northwest corner of Broadway and Avocado. 2. Prior to the issuance of a building permit, the applicant shall record with the County Clerk and Recorder's Office an executed Waivers of Right to Protest Creation of Special Improvements Districts (SID) for the following: a) Street improvements to Fridley Street, including paving curb/gutter, sidewalk and storm drainage; and b) Street improvements to Broadway Avenue, including paving curb/gutter, sidewalk and storm drainage. The document filed shall specify that in the event SIDs are not utilized for the completion of these improvements, the.applicant agrees to participate in an alternate financing method for the completion of said improvements on a fair share, proportionate basis as determined by square footage of property, taxable valuation of the property, traffic contribution from the development or a combination thereof. 3. Prior to the issuance of a building permit, two accessible parking spaces shall be designated as reserved for the disabled within the retail store parking lot by,signs that comply with A.D.A. requirements. Raised signs shall be located at a distance no greater than 5' from the front of each accessible space per Section 18.50,120.F.3.c; shall be a minimum of 6' above the finished grade of the lot; and shall include the language "Permit Required$100 Fine". A detail must be submitted with the Final Site Plan. 4. More recent developments include the 8,568 square foot Truss Manufacturing Building (File#Z-9062 MiSP/COA) and the 13,728 square foot Simkins-Hallins Retail Store (#Z-92117 PUD). (The FSP deadline for the warehouse proposed under File#Z-98166 has expired, and Rusty of Simkins-Hallin has indicated they will not pursue the project.) The proposed addition is a+68% increase in the size of the existing Truss Manufacturing Building, a+26% increase over the two buildings constructed after 1990, and a ±12% increase over the total footprints of buildings in the complex. Although situated along what has been platted as Front Street, the building and addition would be some distance from improved Broadway Avenue, and the project site is located outside of the Neighborhood Conservation Overlay. The 1992 PUD proposal did not include Lots 9-15, Block 49 or the Westland properties on the west side of Broadway. Whether reviewed as a Modification to a FSP approved after 1990 (way over 20%) or as a Mod to a PUD FSP (not technically included, but shown on the PUD vicinity maps) or as a Minor Site Plan, the following issues should be addressed: 1. Parking, Employee &Handicapped Accessible - A condition of FSP approval for#Z-9062 was that a 13-spot employee parking lot,just north of the 919 Fridley warehouse, must be paved within 4 years of 02/17/92, the date of the letter spelling out revised conditions. This allowance was made because the applicant planned to submit a PUD application for the overall site and retail store. An ACE memo directing Dave Grigsby to revise the IA to reflect this is in the file, but no evidence of a revised IA. There is also no signed approved FSP. The condition relating to employee parking in the PUD review was: "That in the event the dust control/abatement program [no documentation on what the program is] fails, and dust from the lot becomes a problem, that the applicant be required to pave the truss plant employee parking lot as originally conditioned in the approval of the truss plant Conditional Use Permit [minor site plan]." Neither an employee parking area as originally proposed on the east side of the Truss Building nor the employee parking area proposed just north of the 919 Fridley warehouse exist. Both areas appear to be used as storage. There are about 100 employees per one of the employees there, likely a combination of full and part time. Rusty noted that the "designated" employee parking areas are within the Retail Store lot and on the property located at the northwest corner of Broadway& Avocado. The "designated" employee parking lot, which lies just north of the berm along the Avocado Street r-o-w, is gravel and, at the time I visited, contained roughly 43 vehicles. There appears to be room for at least another 15. The center of the lot contains a pile of roofing material which is intended to be picked up by"any contractor wishing to haul it away". According to the C&R records, Westland, Inc. owns only the southern tip of this parking area, and the remainder is owned by Charles Schlegel. The parking lot provided around the Retail Store falls short of minimum requirements for retail and the FSP was approved providing 31 regular and 2 handicapped spaces. Calculations for the retail use should have been as follows. Retail: 10272 S.F./300 =34 plus 2 HC or 13,728 S.F. x 85% = 11,668.8/300 = 38.9 or 39 plus 2 HC Only one HC space is provided on site and the signage is located on the retaining wall at a height of less than 4 feet, does not contain the $100 fine language, and is easily blocked. The employee parking area issues should be resolved. A striped and paved lot in this area might be more appropriate considering the residential adjacencies to the south and the other businesses on the east side of Broadway, which have paved lots. The proper written agreements should be obtained from Mr. Schlegel. If paving and striping are not an issue, at least the ownership issue should be resolved. The existing handicapped accessible space in the Retail Store lot should be adequately signed. Also relating to parking, a condition of the Retail Store approval(#Z-92117) was that "no parking" signs be installed along the front of the retail store. There are no such signs. Although it is likely obvious to customers that parking is not allowed there, some curb painting might meet the intention of the condition if it is still an issue. 2. SID Waivers - The minor site plan review of the Truss Building (#Z-9062) required SID waivers for improvements to Front, Fridley and Broadway. The original signed waivers are in the file, but do not contain Phill's signature and have never been recorded as verified at the C&Rs. With the PUD (#Z-92117) waivers were required for improvements to Front and the signalization of Peach/Rouse. These have been recorded under Film 127 Page 3119-3122. If improvements to Fridley and Broadway are still issues, those waivers should be obtained with this proposal. If the Broadway/Front truck route is still part of the transportation plan, there may be other considerations, including the existence of a building over the platted Front Street r-o-w and other transportation network improvements. 3. Other Proposed Site Plan Notes - What is called out as a "vacated alley"just south of the existing Truss Building beginning on the vacated portion of McAdow Avenue southeast to the Mill Ditch is a storm drain easement (Fihn I I I Page 1593). The existing water service line appears to run under the proposed addition along the existing building's western elevation. The existing building has had a 925 East Fridley Avenue address, and the proposal references a 512 North Broadway Avenue address. If the address is proposed to change, the change should be to a Front Street address as the building is a considerable distance from both Fridley and Broadway. With the exception of the above items, all other conditions of approval for the reviews after 1990 appear to have.been met. I will be glad to discuss the proposal with you further at your convenience. MINUTES OF THE MEETING OF THE CITY COMMISSION BOZEMAN, MONTANA October 26, 1992 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, October 26, 1992, at 3:30 p.m. Present were Mayor Swanson, Commissioner Frost, Commissioner Stiff, Commissioner Vincent, Commissioner Knapp, City Manager Wysocki, City Attorney Luwe and Clerk of the Commission Sullivan. The meeting was opened with the Pledge of Allegiance and a moment of silence. None of the Commissioners requested that any of the Consent Items be removed for discussion. Minutes - October 19, 1992 It was moved by Commissioner Frost, seconded by Commissioner Stiff, that action on the" minutes of the regular meeting of October 19, 1992, be delayed for a period of one week, so the corrections can be submitted in writing. Decision - CUP for PUD - Westland Corporation - to allow construction of new retail building and relocation of offices and retail operation - Lot 18, Block 46, Lots 16 through 27, Block 49. Block 46 and Lots 9 through 16, Block 46, and an irregular shaped parcel containing 3.98 acres, Northern Pacific Addition (300 Block North Broadway) This was the time and place set for the decision on the application submitted by Westland Corporation for a Conditional Use Permit for a Planned Unit Development, under Application No. Z-92117, to allow construction of a new retail building and relocation of offices and retail operation on Lot 18, Block 46, Lots 16 through 27, Block 49, Lots 1 through 8, Block 46, and Lots 9 through 16, Block 46, and an.irregular shaped parcel containing 3.98 acres located in the Northern-Pacific Addition. The subject parcel is more commonly located in the 300 block of North Broadway Avenue. The City Manager reminded the Commission that the public hearing on this item was conducted atlast week's meeting. He then noted that, included in the Commissioners' packets, 10-26-92 - 2 was a memo from Assistant Planner Dave Grigsby, dated October.22, forwarding two proposed additional conditions and revisions to two of the conditions forwarded by the City-County Planning Board, as a result of the public testimony and Commission discussion at last week's public hearing. At the Mayor's request, Planning Director Andy Epple reviewed the revised and added conditions as contained in the memo forwarded by Planner Grigsby. He noted that this planned unit development includes a mixture of retail, wholesale, manufacturing and storage. He stated that Condition No..27 simply provides for painting or re-siding of the existing structures on the property to match or complement the new structure, as the applicant has already indicated he plans to do. He also noted that Condition No. 28 simply requires that the lighting on the site be in compliance with the requirements of the City's zone code. He then indicated that Condition No. -5 is to be revised to refer to Front Street, rather than its designation.in the proposed transportation plan update of "arterial/peripheral truck route". He noted this is in response to a concern raised by some of the Commissioners that the transportation plan update has not yet been adopted by the City Commission; and it seems inappropriate to include some of the phraseology from that document in the approval of an application. He noted that Condition No. 11 has been revised to clarify its I intent, which is to require the installation of sidewalks in conjunction with this application, rather than at some time in the future. Responding to Commissioner Knapp, the Planning Director stated that the applicant or future owners of the property must abide by the limits for noise level established in the zone code. Commissioner Knapp stated that, while she is not concerned about noise levels in conjunction with this applicant, she feels that the issue must be addressed for all applications, so it does not become forgotten. Responding to questions and concerns from Commissioner Frost, Planning Director Epple stated that Condition No. 15 would require that, if the East Fridley Street right-bf-way is not vacated, the applicant will be required to pave it to a minimum width of 24 feet, in a design that will accommodate future upgrading to a City street standard. Responding .to Mayor Swanson, the Planning Director indicated that the conditions, as recommended, adequately reflect the Director of Public Service's suggestion that the looped water line be completed prior to issuance of an occupancy permit. It was moved by Commissioner Stiff, seconded by Commissioner Vincent, that the Commission approve the Conditional Use Permit for a Planned Unit Development, under Application 10-26-92 I - S - 3 - No. Z-92117, to allow construction of a new retail building and relocation of offices and retail operation on Lot 18, Block 46, Lots 16 through 27, Block 49, Lots 1 through 8, Block 46, and Lots 9 through 16, Block 46, and an irregular shaped parcel containing 3.98 acres located in the Northern Pacific Addition, subject to the following conditions: 1 . That the applicant submit a revised site plan to the Planning Office identifying the following landscape related items, prior to final site plan approval: A. All of the interior landscape islands shall be landscaped with the plantings as shown, and shall be seeded in grass or sod and noted on the final site plan; B. All landscaped areas shall be provided a hose bib or adequate . underground irrigation system located within each landscaped area, and identified on the final site plan; C. Landscaping, including boulevard trees (where applicable), grass, screening, and buffering requirements shall be installed. the entire length of the property bordering North Broadway Avenue (excluding drive accesses), and along the subject property bordering the residences'to the south, and shall be located and identified on the final site plan; D. That the applicant submit a revised site plan identifying all dropped curbs, continuous curbing, wheel stops, handicapped accessible ramps, 4-inch wide painted striping, for review and approval by the Planning Office prior to final site plan approval; 3. All interior sidewalks shall be raised above parking lot surface the height of a standard continuous curb, and noted on the final site plan; 4. "No .Parking" signs shall be installed along the length of the drive isle bordering the sidewalk at the front of the new retail store; 5. The applicant shall file waivers of protest to the creation of an S.I.D. for future improvements to Front Street, and for the creation of an S.I.D for the signalization of the intersection of Peach Street and Rouse Avenue; 6. The stormwater drainage/treatment plan basin sizing and discharge calculations, discharge destination, and a stormwater maintenance plan must be submitted to and approved by the City Engineer; 7. Plans and specifications for the water main extensions prepared by a Professional Engineer (PE) shall be provided to and approved by the City Engineer and the Montana Department of Health and Environmental Sciences. The applicant shall also provide professional engineering services for construction inspection, post-construction certification, and preparation of mylar record drawings; 10-26-92 - 4 - 8. Plans and specifications for any proposed water main and hydrants, or fire service line must be prepared by a Professional Engineer (PE), and be provided to and approved by both the State Water Quality Bureau and the City Engineer prior to initiation of construction of the water main and hydrants, or fire service or fire protection system, The applicant shall also provide professional engineering services for the construction inspection, post-construction certification, and preparation of mylar record drawings; 9. That the proposed water main and hydrants as shown on the plans and submitted to the State Water Quality Bureau and the City Engineer, be installed and in service prior to occupancy of the new building, and that no occupancy permits shall be granted nor any financial guarantees accepted prior to said installation and completion of the service; 10. Sewer and water (domestic and/or fire) services shall be shown on the final site plan and approved by the Water/Sewer Superintendent. City of Bozeman applications for service shall be completed by the applicant; 11. A sidewalk shall be installed to City standards, the length of, and within the North Broadway Street boulevard bordering the property, and shown on the final site plan; and the sidewalks and parking lot approaches shall be constructed in accordance with the City's standard approach (i.e. concrete apron, sidewalk section, and drop-curb). and shown as such on the final site plan. A city curb cut and sidewalk permit shall be obtained prior to final site plan approval; 12. Asphalt or concrete headers shall be provided around the perimeter of all new asphalt not contained by a concrete curb; 13. The configuration of the off-street parking area shall comply with the requirements of 18.50.120 of the Zone Code unless a deviation or variance is granted by the governing body. In particular the narrow drive aisles between the buildings, and the northeast access must meet code requirements for width; 14. The extent of the previous Fridley Street vacation must be delineated; 15. Fridley Street shall be designed for paving to a City of Bozeman local street standard, including curb/gutter and sidewalk, and shall be completed to a minimum width of 24 feet by the applicant in such a manner as to lend to future completion to the City standard. Paving shall be completed to the eastern-most parking lot access. If Fridley Street is vacated, the Design Review Committee recommends the adjoining property owners enter into an agreement for a shared access at the existing right-of-way centerline; 16. All existing and proposed utility and other easements must be shown on the final site plan. City standard form water line easements shall be filed by the property owner prior to final site plan approval; 17. Adequate snow storage area must be designated outside the access sight triangles, but on the subject property (unless a snow storage easement is obtained for a location off the property and filed with the County Clerk and Recorder); 18. That in the event the dust control/abatement program fails, and dust from the lot becomes a problem, that the applicant be required to pave the truss plant employee parking lot as originally conditioned in the approval of the truss plant Conditional Use Permit;' 10-26-92 I I 19. That the existing on-site structures bordering and facing North Broadway Street and the adjacent R-3A residential zone, be painted, or the siding be replaced with colored siding to match or complement the proposed new retail structure; 20. That all exterior lighting comply with all City standards for exterior lighting as set forth in Section 18.50.035A and Section 18.50.120E of the Code, and be shown in detail on the final site plan; 21. The right to a use and occupancy permit shall be contingent upon the fulfillment of all general and special conditions imposed by the Conditional Use Permit procedure; 22. That all of the special conditions shall constitute restrictions running with the land use and shall be binding upon the owner of the land, his successors or assigns; 23. That all conditions specifically stated under any conditional use listed in this ordinance shall apply and be adhered to by the owner of the land, successors or assigns; 24. That all of the special conditions shall be consented to in writing by the applicant; 25. Seven copies of the final site plan containing all of the conditions, corrections, and modifications approved by the City Commission shall be. submitted for review and approved by the Planning Director within six months of the date of City Commission approval. Signed copies shall be retained by the City departments represented on the Development Review Committee, and one signed copy shall be retained by the applicant; 26. The applicant shall enter into an Improvements Agreement with the City to guarantee the installation of required on-site improvements at the time of final site plan submittal. Detailed cost.estimates, construction plans and methods of security shall be made a part of that agreement; 27. The first building permit must be obtained within one year of final site plan approval. Building permits will not be issued until the final site plan is approved. No site work, including excavation, may occur until a building permit is issued. If occupancy of the structure or commencement of the use is to occur prior to the installation of all improvements, the Improvements Agreement must be secured by a method of security equal to one and one-half times the amount of the estimated cost of the scheduled improvements not yet installed.
