Bozeman, Montana November 17, 1988 Dear Andy: After meeting with you two weeks ago and Dave Skelton on the site yesterday, I think we have all the site improvements done for Don Weaver' s Conditional Use Permit for office #3, Westridge Center. Dave suggested that I mention the adjustments that we made to the final site plan while getting the building and landscaping in place . `They are as follows : 1 . We chose not to place a dumpster on site at this time . Westridge P&D is providing for garbage removal . If we do locate a dumpster on site in the future, it will be located much closer to the building between the parking lot and the 35 foot stream setback. 2 . The outside lights shown on the landscaping plan were eliminated. Between the street lights on Kagy and the building mounted exterior lights, there is no need for additional lighting. 3. Parking stall 411 was relocated next to stall #5 . After situating the building and parking lot we found that there was more room than we anticipated on paper. There are still only 15 parking spaces as per the original plan. 4. The sidewalk between the building and proposed dumpster location was paved rather than built of concrete . This gave us a better turning radius into the parking area. To keep the parking area drainage moving toward Kagy, rather than directly to the creek, the west edge was raised to comply with the submitted drainage plan. 5 . The screen-fence along the south side was reduced from 8 feet to 6 feet . This was discussed in the 10-10-88 letter to you. 6 . The proposed fence along Kagy Blvd. was eliminated as it created a traffic hazard at the intersection of Kagy and Fairway. It also left no room for snow removal from the sidewalk on Kagy. To achieve screening of the parking lot we have planted aspen trees and dogwood bushes between the parking stalls and the street . This item was also detailed in the 10-10-88 letter. 7. After installing the landscaping buffer between the parking lot and Fairway Drive we decided to eliminate the proposed fence . The 6 foot fence would provide no significant screening as it would sit in the barrow pit, which varies from 2 to 4 feet below the road level . Visually, the fence would detract from the site more than it would add. 1 i 8. The last item on the site plan that we modified was the curbing. Use of the parking lot over the last 8 months has shown that there is no need for additional curbing to direct drainage or vehicular traffic . Curbs in addition to the existing wheel stops and sidewalks would add substantially to the problem of snow removal . What I would like from you is a letter indicating that the conditions of approval for the Conditional Use Permit for Westridge Meadows Office #3 have been met and that no further improvements will be required. If I do not hear from you within 3 weeks (by December 8, 1988) I will assume that we have completed the conditions of approval . Weaver to allow construction of a 4064-square-foot office building on Lot 6 of Westridge Meadows No. 3. This site is more commonly known as being located in the 1900 block of Fairway Drive. Mayor Mathre opened the public hearing. Assistant Planner Dave Skelton presented the Staff Report. He stated the 'subject site is 0.68 acres in size and is located at the southwest corner of the intersection of Kagy Boulevard and Fairway Drive. He- noted the site is located south of the Westridge Meadows ; Planned Unit Development; and is not a part of that master plan or the covenants for that project. The Assistant Planner indicated that the applicant wishes to construct a two-story office building containing 4064 square feet. He noted the building is to be wood frame with stucco and cedar sidingand an asphalt shingle roof, similar.to those located just p 9 1 across Fairway Drive in the office complex area. He stated that 13.8 off-street parking 08-04-86 -14- • spaces are required; and the applicant has proposed 16. Assistant Planner Skelton stated the subject "T" area contains five general criteria to be addressed. He noted that the one directory sign to be installed in the front yard complies with the criteria; the proposed 22-foot-high structure does not exceed the 24-foot limitation; access will be from- Fairway Drive to Kagy Boulevard, avoiding direct access to ° that arterial; and existing vegetation will provide much of the necessary screening to the south and the west. The Assistant Planner indicated that the applicant had proposed a 4-12 pitch roof; and the area residents requested a 6-12 pitch roof to ,blend with the residential development, with everyone compromising on a 5-12 pitch roof. The Assistant Planner noted that a portion of the subject site is located within the 100-year floodplain. . He also noted that a 35-foot streambank setback must be observed; and it has been. Assistant Planner Skelton stated that the Zoning Commission reviewed this application and concurred in the staff recommendation for approval, subject to nine conditions. Mr. Robert Lee, representing Don Weaver, submitted a brief history of the subject lot. He noted the zoning on the subject parcel was approved in 1977, and has been designated for office use since that time. He noted that a review of the topography in the area shows that water would need to be four feet over Kagy Boulevard to get into the proposed building; and the 100-year flood projects one foot over Kagy Boulevard. He noted the site is generally covered with trees, mostly quaking aspen. He noted that the area where the building and parking lot are to be located will be cleared, with all trees over one inch in diameter being transplanted to the perimeter of the site. Mr. Lee indicated that the office building will be set back 110 feet from Fairway Drive and 175 feet from the nearest residential development to the south. He noted the design of the building is similar to that of the existing office buildings; and they have agreed to use the same color as that used on the condominiums to the south. HF indicated that the use of stucco on a portion of the structure will help it to blend with the remain- der of the technical center. Mayor Mathre asked Don Weaver if he agrees to all of the conditions recommended by the Zoning Commission; and he indicated that he does. Mayor Mathre closed the public hearing. It was moved by Commissioner Martel, seconded by Commissioner Vant Hull, that the Commission waive the customary one-week waiting period. That the final site plan comply with Sections 18.62.170 and 18.62.180 regarding snow removal storage area and landscape/irrigation system and Section 18.52.130(C) regarding landscaping design plan. 7. That the developer shall enter into an Improvements Agreement with the City of Bozeman. If occupancy of the structure is to occur prior to installation of the improvements, it must be secured by a method of security equal to one and one-half (11) times the amount of the cost of the scheduled improvements and their installation. Detailed cost estimates, construction plans and method of security shall be made a part of that agreement. 8. That three copies of the final site plan containing all the conditions, corrections and modifications approved by the City Commission be submitted for review and approved by the Planning Director within six months of the date of the City Commission approval, and prior to the issuance of a building permit for the project. One signed copy shall be retained by the Building Inspection Division; one signed copy shall be retained by the Planning Director; and one signed copy shall be retained by the applicant. 9. All on-site improvements (i.e. , paving, landscaping, etc.) shall be completed within 18 months of approval of the Conditional Use Per- mit. The Conditional Use Permit shall be valid for a period of only 18 months following approval of the use. Prior to the permanent re- newal of the permit at the end of that period, the applicant must satisfy all the conditions in the granting of the permit. An on-site inspection will be made and a report made to the City Commission for their action. If all required conditions have been satisfied, the ' permit will be permanent renewed. CONDITIONAL USE TO ALLOW A 4 ,064 SQUARE FOOT OFFICE BUILDING IN AN R-O-T DISTRICT/Donald Weaver , applicant Steve Lere, Planning Director , presented the Staff Report (see file #Z-8638) , showed the project ' s location on the map, and recommended approval of the application with 9 condi- tions as stated in the Staff Report. Mr. Lere then read a letter from James W. Owenhouse (attached) . It was stated that since Fairway Drive is a private drive, it is maintained by a homeowner 's association. Robert Lee, representing the applicant, stated that the West- ridge Meadows area was zoned in 1977 and that a Master Plan of the area was done at that time. This is a heavily wooded area and some of the brush has been removed for ease of lot layout plans. Mr . Lee added that they intend to move the mature aspens to buffer Kagy Boulevard and Fairway Drive in the fall . An 8 foot cedar fence is proposed on the southern property line, and a 6 foot cedar fence on the other property lines , with the exception of the sight triangle. Mr. Lee stated that Clair Daines had objected to the proposed 4 : 12 roof pitch, and to compromise, they plan to build a 5 : 12 pitched roof. Because of height limitations, a 6 : 12 roof could not be built. To help merge the design characteristics of the office building with the residences, they intend to use the same building elements as used on the other office buildings with some exceptions. Don Weaver, applicant, discussed at length the owner ' s and homeowner ' s associations, how they are formed and what their responsibilities are. He stated he is working with the associations as well as with Clair Daines, who designs and builds the condos . There is one office lot left in the West- ridge Meadows development, as well as approximately 10 acres of residential sites . PUBLIC PORTION of the meeting was opened. James Owenhouse, president of the homeowner ' s association, stated their association was concerned that the office build- ing be compatible with the existing neighborhood, and stated that a steeper pitched roof, shaked roof and coordinated color tones would help alleviate their concerns. Mr . Weaver stated they have agreed to use a 5: 12 pitched roof, use a gable end which will fit in better with the existing structures, and will use the same paint tones as are used in the condos. Because of fire safety, he stated he would rather not use shakes for the roof, but will choose an attractive asphalt shingle. Kagy Blvd. We are concerned that any developement at this location be in harmony with the high quality residential development which now exists at the Meadows of Westridge and other adjacent property. Many Of us were surprised to learn of a proposal for construction at this site as a commercial building was not indicated on the master development plan which was approved by the city before the residential units were started.
