WHEREAS, it is the intent and purposes of the Developer to meet the conditions of approval for the Conditional Use Permit allowing the construction of a restaurant within the Volz-Wallin PUD, as approved. WHEREAS, it is the intent and purposes of the Developer to obtain Final Site Plan Approval ; WHEREAS , it is the intent and purposes of both the Developer and the City to hereby enter into an Agreement which will guarantee the full and satisfactory completion of the required improvements on the property hereinafter described; and it is the intent of this Agreement,', and of the parties hereto, to satisfy the improvements guarantee requirements for the Final Site Plan approval of said Conditional Use Permit; NOW, THEREFORE, in consideration of the mutual covenants and conditions contained herein, it is hereby agreed as follows : 1 . Property Description This Agreement pertains to, and includes, those properties which are designated and identified as a portion of Tract VW-2 of Certificate of Survey #1227 , located within the Volz-Wallin Annex- ation to the City of Bozeman, Montana . 2 . Improvements This Agreement specifically includes the installation of paved parking areas, driveways, lighting, landscaping, fencing, .and other improvements as illustrated on the plans and specifica- tions hereto attached and made a part of this Agreement, as Exhibit "A" . The estimated cost of said improvements is attached and made a part of this Agreement, as Exhibit "B" . 3. Financial Guarantee, Time for Completion of Improvements The water , sanitary sewer , storm drainage, and road i improvements must be completed in an acceptable manner as shall be determined by the City Engineering Officer , prior to the occupancy of the structure in question. If occupancy of any structure is to occur prior to the completion of the other site improvements, they must be secured by a financial guarantee, as may be deemed acceptable by the City, payable to the City of Bozeman, in an amount equal to' one and one- half times the estimated cost of the installation of any required improvements not completed at that time. In any event, all required improvements on the site as deli- neated on Exhibit "A" , which is attached and made a part of this Agreement, shall be completed within eighteen (18) months of written approval of the Final Site Plan by the Local Governing body, or their designated representative. 4 . Inspection Representatives of the City shall have the right to enter upon the property at any reasonable time in order to inspect it and to determine if the Developer is in compliance with this Agreement, and the Developer shall permit the City and its repre- sentatives to enter upon and inspect the property at any reasonable time. 5 . Default Time is of the essence of this Agreement. If the Developer shall default in or fail to fully perform any of its obligations i in conformance with the time schedule under this Agreement, and such default or failure shall continue for a period 'of five (5) days after written notice specifying the default is deposited in the United States mails addressed to the Developer at PO. �t7X j�Cj�C II•I�IN( ,�� ��p'j , or such other address as the Developer shall provide to. the City from time to time, with- out being completely remedied , satisfied , and discharged, the City may elect to enforce any of the following specified remedies: A. (1) The City' s representative, contractors, and engineers shall have the right to enter upon the property and perform such work and inspec- tion, and the Developer shall permit and secure any additional permission required to enable them to do so. B. The City may enforce any other remedy provided by law. 6 . Warranty The Developer shall warrant against defects in these improve- ments for a period of one year from the date of their written acceptance by the governing Body. 7 . Governing Law This Agreement shall be construed according to the laws of the State of Montana. 8 . Modifications or Alternations No modification or amendment of this Agreement shall be valid , unless evidenced by a writing signed by the parties hereto. 9 . Invalid Provision The invalidity or unenforceability of any provision of this Agreement shall not affect the other provisions hereof, and this Agreement shall be construed in all respects as if such invalid or unenforceable provision were omitted. 10. No Assignment It is expressly agreed that the Developer shall not assign this Agreement in whole, or in part, without prior written consent of the City. 11 . Location/Description The property in question includes Lots 1 and 2 , West Main 1 Business Plaza, Triangle Area Annexation to the City of Bozeman. It is more generally described as 503 Professional Drive . i �I B dID so y B- ;I I _ V� "rfia Sim 1�I J -2-T Maio W L Q W I d r�o B' 'a Proposal The property in question is currently zoned "B-2-T" (community Highway Business - Transitional) District, thus the applicant. is seeking a Conditional Use Permit to allow the construction and operation of a restaurant on the site. The applicant previously applied for and was .granted a Conditional Use Permit by the Bozeman City Commission on August 27 ,, 1984 . However , the applicant failed to complete the Final Site Plan approval process within the time frame established - as a condition of the City Commission ' s approval . Thus the applicant has submitted this application. To briefly review the applicant ' s proposal , the plan indicates that the structure will be located on the southern extreme of the property. Parking and landscaping would be generally located north of the proposed structure. A compact car parking design will be utilized for a portion of the required parking. The single story structure will incorporate a brick front with a diagonal cedar and shake cedar roof facade. It should be noted that the brick facade will extend out to the north an additional 12 inches from the building line indicated on the Site Plan. Extensive landscaping has been proposed in the required yard areas to buffer the parking area from the adjacent streets. Additionally, interior parking area landscaping in excess of the six percent requirement has been provided. The Engineering Office has reviewed the drainage plan . There remains some concern regarding the design and location of the storm sewer inlet adjacent to the northern entrance from Professional Drive . An elevation of the sign proposed for location on the property has been included with the submittal . The overall height of the proposed sign is 35 feet. The design, size and location of the proposed sign appears to be appropriate for the site. Staff Findings : The Zoning Code indicates that the transitional zone within which this property is located was adopted with the intent of protecting the residential land uses which have developed to the east of the "B-2" Zone. The Code recommends the use of height restrictions, signing restrictions, landscaping and exterior construction to lessen any detrimental effects on the nearby residential development. In general , the applicant ' s proposal appears to be appropriate to the site. The applicant has. amended his earlier submittal to meet the conditions placed on the previous approval . Conclusion: The Planning Staff recommends conditional approval of the application for a Conditional Use Permit to construct and .operate a ' restaurant in a "B-2-T" -. (Community Highway Business- Transitional) District, with the following conditions : (1) That the design , location and installation storm sewer inlet at the northern entrance to Professional Drive be reviewed and approved by the City Engineering Officer; (2) The. developer shall enter into an Improvements Agreement with the City of Bozeman. If occu- pancy of the structure is to occur prior to installation of the improvements, it must be secured by a method of security equal to one and one-half (1 1/2) times the amount of the cost of the scheduled improvements and their installation. Detailed cost estimates, cons- truction plans and methods of security shall be made part of that agreement; (3) Three (3) copies of the Final Site Plan con- taining all the conditions, corrections and modifications approved by the City Commission shall be submitted for review and approved by the Planning Director within six (6) months of the date of the City Commission approval , and prior to issuance of a building permit for the project. One (1) signed copy shall be retained by the Building Department, one (1) signed copy shall be retained by the Planning Director , and one ( 1) signed copy shall be re- tained by the applicant; (4) All on-site improvements ( i .e. , paving , land- scaping, etc. ) shall be completed within eigh- teen (18) months of approval of the Conditional Use Permit. The Conditional Use Permit shall be valid for a period of only eighteen (18) months following approval of the use. Prior to the per- manent renewal of the permit at the end of that period, the applicant must satisfy all the condi- tions in the granting of the permit. This parcel has been divided off one of the original tracts, through an occasional sale exemption. Proposal The applicant is proposing to construct a Perkins Cake and Steak Restaurant on the property in question. The structure would be located at the northwest corner of the property. The exterior of the structure would incorporate a variety of architectural treatments, including rough-sawn cedar , stucco, face brick, cedar facing ; .and shake shingles. Additional archi- tectural details have been added , including paned windows and doors and planters along the front of the structure as it faces Belvedere. Staff Findings The Volz-Wallin PUD was reviewed through the . Development Guidelines system. An extensive set of Land Use Development Guidelines were reviewed and approved in addition to a site plan which addressed water and sanitary sewer facilities, storm sewer drainage and vehicular circulation system improvements.. Under the Development Guidelines system, individual development proposals are reviewed through the Minor PUD procedure. The development. proposal must comply with the Bozeman City Zoning Code as well as the Land Use Development Guidelines approved as part of the original PUD. The Planning Staff has reviewed the proposal submitted for this first project within the Volz-Wallin PUD. In general , the application appears to be well done and fairly complete. Several minor additions should be made to the development plans. Although adequate areas for snow storage appear to be available on the site, additional snow storage areas should be designated. Parking area lighting has been designated; however , an elevation of the light standard to be utilized has not been provided . An elevation of the light standard should be added to the site plan. The parking area is of primary concern because of its relatively large size and location along U.S . 191 , a major entrance to the community. Buffering has been proposed along U.S. 191 . Seventy-five, off-street parking spaces are proposed, well above the minimum requirement of 44 prescribed by the Zoning Code. According to the Staff ' s calculations, the proposal appears to be 110 square feet short of the 6 percent interior parking area landscaping requirement. This should be added to the Final Site Plan. The five parking spaces proposed for location at the southernmost area of the parking lot do not appear to be adequately designed . To exit from one of those spaces , a vehicle , might have to back up as much as 60 or 70 feet. The Engineering Staff has suggested that three spaces be installed there, 2 allowing backing directly onto the parking aisle area from each space. Some additional information regarding the parking area improvements should also be included on the site plan, including a paving cross-section detail and a stand up curb detail (may be shown together) . The site plan must also address the entire street approach with a minimum throat width of 24 feet . A five- . foot radius each side of the approach must also be shown . The location of existing public facilities must be shown where applicable, including the location of water and sewer mains, fire hydrants , and manholes . The location of sewer and water service lines to the structure must also be identified. A detached , "Perkins" sign, modified to meet the Land Use Development Guidelines for the Volz-Wallin PUD, is proposed for location along U.S . 191 . The sign, as delineated on the site. plan, would extend over a city utility easement. Further , it would also be located within the 25-foot front yard setback. The detached sign should be relocated outside the required setback to bring the proposal into compliance with the Bozema.n . City Zoning Code and the approved Land Use Development Guidelines . Two additional items were identified in the Staff ' s review of the Land Use Development Guidelines as they relate to the applicant ' s proposal . Rain gutters must be installed on the structure to preclude the accumulation of precipitation on adjacent pedestrian walks . Further , pedestrian ways are required to be located in a manner to encourage pedestrian access through the development . No pedestrian walks to adjacent properties have been provided within this proposal . The City Engineering Officer and the City Building official have noted the importance of insuring that certain facilities are installed prior to occupancy of the proposed structure. Water , sanitary sewer, and storm drainage improvements to provide adequate service to the proposed development must be installed prior to occupancy of the proposed structure. Pavement of Belvedere to the northern property line must also be completed to a degree acceptable to the City Engineering Officer prior to occu- pancy of the structure. These improvements are necessary to insure the public health safety and general welfare. Conclusion The proposed development appears to comply with development concepts established within the Land Use Development Guidelines. The proposed structure is a creative adaptation of a standardized franchise structure to a unique development concept. The pro- posed site improvements appear to advantageously develop this un- usually shaped property. The Planning Staff would recommend condi- tional approval of the application for a Conditional Use Permit with the following conditions : 3 l) Additional snow storage areas, an elevation of the lighting standard , full approach width and improve- ments, the radius on the approaches, a stand-up curb detail , a paving cross-section detail , location of existing water and sewer mains, fire hydrants, man- holes, sewer and water service lines, and an additional 110 square feet of interior parking lot area landscaping must be delineated on the Final Site Plan; (2) The five parking stalls located at the southern end of the parking shall be reduced to three stalls and relocated in a manner to allow backing directly into the traffic aisle. Detailed cost estimates and construction plans shall be made a part of that Agreement; � (8) That three copies of the Final Site Plan containing 0 all the conditions , corrections, and modifications approved be submitted for review and approved by the Planning Director within six months of the date of . the CityCommission approval , and prior to issuance of a building permit for the project . R-0 6-2- 1 It is located within the Volz-Wallin PUD which was approved by the City Commission on June 10, 1985. • This parcel has been divided off one of the original tracts, through an occasional sale exemption. Proposal The applicant is proposing to construct a Perkins Cake and Steak Restaurant on the property in question . The structure would be located at the northwest corner of the property. The exterior of the structure would incorporate a variety of architectural treatments , including rough-sawn cedar , stucco, face brick, cedar facing , and shake shingles. Additional archi- tectural details have been added , including paned windows and doors and planters along the front of the structure as it faces Belvedere. Staff Findings The Volz-Wallin PUD was reviewed through the Development Guidelines system. An extensive set of Land Use Development Guidelines were reviewed and approved in addition to a site plan which addressed water and sanitary sewer facilities , storm sewer drainage and vehicular circulation system improvements. Under the Development Guidelines system, individual development proposals are reviewed through the Minor PUD procedure. The development proposal must comply with the Bozeman City Zoning Code as well as the Land Use Development Guidelines approved as part of the original PUD . The Planning Staff has reviewed the proposal submitted for this first project within the Volz-Wallin PUD. In general , the application appears to be well done and fairly complete . Several minor additions should be made to the development plans. Although adequate areas for snow storage appear to be available on the site, additional snow storage areas should be designated . Parking area lighting has been designated; however , an elevation of the light standard to be utilized has not been provided . An elevation of the light standard should be added to the site plan. The parking area is of primary concern because of its relatively large size and location along U.S . 191 , a major entrance to the community. Buffering has been proposed along U.S. 191 . Seventy-five, off-street parking spaces are proposed, well above the minimum requirement of 44 prescribed by the Zoning Code. According to the Staff ' s calculations, the proposal appears to be 110 square feet short of the 6 percent interior parking area landscaping requirement. This should be added to the Final Site Plan. The five parking spaces proposed for location at the southernmost area of the parking lot do not appear to be adequately designed . To exit from one of those spaces , a vehicle. might have to back up as much as 60 or 70 feet. The Engineering Staff has suggested that three spaces be installed there, 2 allowing backing directly onto the parking aisle area from each space. Some additional information regarding the parking area improvements should also be included on the site plan, including a paving cross-section detail and a stand up curb detail (may be shown together) . The site plan must also address the entire street approach with a minimum throat width of 24 feet . A five- foot radius each side of the approach must also be shown . The location of existing public facilities must be shown where applicable, including the location of water and sewer . mains, fire hydrants , and manholes . The location of sewer and water service lines to the structure must also be identified. A detached , "Perkins" sign, modified to meet the Land Use Development Guidelines for the Volz-Wallin PUD, is proposed for location along U.S. 191 . The sign, as delineated on the site plan, would extend over a city utility easement. Further , it would also be located within the 25-foot front yard setback. The detached sign should be relocated outside the required setback to bring the proposal into compliance with the Bozeman City Zoni.ng Code and the approved Land Use Development Guidelines. Two additional items were identified in the Staff ' s review of the Land Use Development Guidelines as they relate to the applicant ' s proposal . Rain gutters must be installed on the structure to preclude the accumulation of precipitation on adjacent pedestrian walks. Further, pedestrian ways are required to be located in a manner to encourage pedestrian access through the development . No pedestrian walks to adjacent properties have been provided within this proposal . The City Engineering Officer and . the City Building Official have noted the importance of insuring that certain facilities are installed prior to occupancy of the proposed structure. Water, sanitary sewer, and storm drainage improvements to provide adequate service to the proposed development must be installed prior to occupancy of the proposed structure. Pavement of Belvedere to the northern property line must also be completed to a degree acceptable to the City Engineering Officer prior to occu- pancy of the structure. These improvements are necessary to insure the public health safety and general welfare. Conclusion The proposed development appears to comply with development concepts established within the Land Use Development Guidelines. The proposed structure is a creative adaptation of a standardized franchise structure to a unique development concept. . The pro- posed site improvements appear to advantageously develop this un- usually shaped property. The Planning Staff would recommend condi- tional approval of the application for a Conditional Use Permit with the following conditions : 3 (1) Additional snow storage areas, an. elevation of the lighting standard , full approach width and improve- ments, the radius on the approaches, a stand-up curb detail , a paving cross-section detail , location of existing water and sewer mains, fire hydrants, man- holes , sewer and water service lines , and an additional 110 square feet of interior parking lot area landscaping must be delineated on the Final Site Plan; (2) The five parking stalls located at .the southern end of the parking shall be reduced to three stalls and relocated in a manner to allow backing directly into the traffic aisle. (3) The detached , "Perkins sign must be relocated outside the required front yard setback; (4) Rain gutters will be provided where necessary to pre- clude the accumulation of precipitation on all pedes- trian walkways; (5) Pedestrian walkways shall be provided to encourage pedestrian access within the Volz-Wallin PUD; (6) Water, sanitary sewer , and storm drainage improve- ments must be completed and installation of the paving of Belvedere completed in a manner acceptable to the City Engineering Officer from U.S . 191 to the northern property boundary of Phase I of the Volz- Wallin PUD, prior to occupancy of the structure. (7) That the developer shall enter into an Improvements Agreement with the City of Bozeman . If occupancy of the structure is to occur , prior to installation of improvements other than those described in condition #5, they must be secured by a method of security equal to one and one-half (1 1/2) times the amount of the cost of the scheduled improvements and their install"a- tion. Detailed cost estimates and construction plans shall be made a part of that Agreement; (8) That three copies of the Final Site Plan containing all the conditions , corrections, and modifications approved be submitted for review and approved by the Planning Director within six months of the date of the CityCommission approval , and prior to issuance of a building permit for the project. One signed copy shall be retained by the Building Department, one signed copy shall be retained by the Planning Director , and one signed copy shall be retained by the applicant; and (9) All on-site improvements (i .e. , paving , landscaping , etc. ) shall be completed within 18 months of approval of the Conditional use Permit. The Conditional Use 4 Permit shall be valid for a period of only 18 months following approval of the use. Prior to the permanent renewal . of the permit at the end of that period , the applicant must satisfy all the conditions in the granting of the permit. An on-site inspection will be made and a report made to the City Commission for their action. IMPROVEMENTS AGREEMENT FOR Perkins Restaurant This AGREEMENT is made and entered into this day of , 1985, by and between High Tech Construction and Properties, Inc. , hereinafter called the "Developer" , and the City of Bozeman, a municipal corporation of the State of Montana, here- inafter called the "City" . WHEREAS , it is the intent and purposes of the Developer to meet the conditions of approval for the Conditional Use Permit allowing the construction of a restaurant within the Volz-Wallin PUD, as approved . WHEREAS , it is the intent and purposes of the Developer to obtain Final Site Plan Approval; WHEREAS, it is the intent and purposes of both the Developer and the City to hereby enter into an Agreement which will guarantee the full and satisfactory completion of the required improvements .oh the property hereinafter described; and it is the intent of this Agreement,'. and of the parties hereto, to satisfy the. improvements guarantee requirements for the Final Site Plan approval of said Conditional Use Permit; NOW, THEREFORE, in consideration of the mutual covenants and conditions contained herein, it is hereby agreed as follows: 1 . Improvements This Agreement specifically includes the installation of paved parking areas, driveways, lighting, landscaping, fencing, and other improvements as illustrated on the plans and specifica- tions hereto attached and made a part of this Agreement, as Exhibit "A" . ' The estimated cost of said improvements is attached and made a part of this Agreement, as Exhibit "B" . 3. Financial Guarantee, Time for Completion of Improvements The water , sanitary sewer , storm drainage, and ' road improvements must be completed in an acceptable manner as shall be determined by the City Engineering Officer , prior to the occupancy of the structure in question. If occupancy of any structure is to occur prior to the completion of the other site improvements, they must be secured by a financial guarantee, as may be deemed acceptable by the City, payable to the City of Bozeman, in an amount equal to one and one- half times the estimated cost of the installation of any required improvements not completed at that time. In any event, all required improvements on the site as deli- neated on Exhibit "A" , which is .attached and made a part of this Agreement, shall be completed. within eighteen (18)' months of written approval of the Final Site Plan by the Local Governing body, or their designated representative. 4 . Inspection Representatives of the City shall have the right to enter upon the property at any reasonable time in order to inspect it and to determine .if the Developer is in compliance with this Agreement, and the Developer shall permit the City and its repre- sentatives to enter upon and inspect the property at any reasonable time. 5 . Default Time is of the. essence of this Agreement: If the Developer shall default in or fail to fully perform any of its obligations in conformance with the time schedule under this Agreement, and such default or failure shall continue for a period of five (5) days after written notice specifying the default is deposited in the United States mails addressed to the Developer at or such other address as the Developer shall provide to the City from time to time„with- out being completely remedied, satisfied, and discharged, the City may elect to enforce any of the following specified remedies: A. The City may, at its option, declare the financial guarantee to be forfeited and secure the complete construction and inspection of the improvements described herein. (1) The City' s representative, contractors, and engineers shall have the right to enter upon the property and perform such work .and inspec- tion, and the Developer shall permit and secure any additional permission required to enable them to do so. B. The City may enforce any other remedy provided by law. 6 . Warranty The Developer shall warrant against defects in these improve- ments for a period of one year from the date of their written acceptance by the governing Body. 7 . Governing Law This Agreement shall be construed according to the laws of the State of Montana. 8 . Modifications or Alternations No modification or amendment of this Agreement shall be valid , unless evidenced by a writing signed by the parties hereto. 9 . Invalid Provision The invalidity or unenforceability of any provision of this Agreement shall not affect the other provisions hereof, and this Agreement shall be construed in all respects as if such invalid or unenforceable provision were omitted. 10 . No Assignment It is expressly agreed that the Developer shall not assign this Agreement in whole, or in part, without prior written consent of the City. i 11. Successors Except as provided in paragraph, 10, this Agreement shall be binding upon, enure to the benefit of, and be enforceable by the parties hereto and their respective heirs, successors and assigns.
